وحثت المنظمة الحقوقية العالمية الواقع مقرها الرئيسي في نيويورك الحكومةَ السورية على “إنهاء العقاب الجماعي بحق الأسر، وتقديم أدلة على قيام الأشخاص المستهدفين بأعمال غير قانونية، والسماح لهم بالاعتراض على إدراجهم على اللائحة أو إلغاء تجميد أموالهم”.
ويتيح المرسوم رقم 63 لوزارة المالية الاستيلاء على أصول وممتلكات الأشخاص الخاضعين لقانون مكافحة الإرهاب لعام 2012 ونقل مِلكيتها إلى الحكومة السورية.
“بمعاقبة الأشخاص على أساس علاقتهم الأسرية مع المتهم وليس على أساس المسؤولية الجنائية الفردية، يشكل تطبيق وزارة المالية المرسوم 63 عقاباً جماعياً، وهو ما يحظره قانون حقوق الإنسان والقانون الإنساني الدوليّين”، يضيف تقرير “هيومَن رايتس وُوتش”.
وترى “هيومَن رايتس وُوتش” أن المرسوم رقم 63 “يتنافى مع نية الحكومة المعلنة تشجيع السوريين الهاربين من الحرب الأهلية المستمرة منذ 8 سنوات على العودة إلى سوريا”.
وتقول “هيومَن رايتس وُوتش” إنها راجعت وثائق منشورة على الإنترنت تضم جداول بأسماء مئات الأشخاص الذين جُمدت أموالهم المنقولة وغير المنقولة بموجب قانون مكافحة الإرهاب، وإنها تحدثت إلى أربعة أشخاص طالهم المرسوم رقم 63 وإلى قريب أحد الأشخاص وموظف سابق في تسجيل الأراضي.
