الحجاب على نسائها، بقوانين غير منصوصة العربي الجديد \ دلال البزري – كاتبة وباحثة لبنانية ثمّة دول تفرض على نسائها الحجاب بالقانون. مثل المملكة السعودية وإيران وأفغانستان. وثمّة عائلاتٌ بعيدةٌ عن هذه الدول، تحافظ عليه باعتباره من مسلّماتها. فتكون نساؤها كلهن محجّبات. ثمّة بيئات أيضاً، ومحاكم دينية، وطوائف وعشائر وتقاليد قديمة، ومؤسسات خاصة .. هندام نسائها هو الحجاب. ليس قانوناً حرفياً، كما في الدول. ولكن القصاص على عصيانه يتجاوز السجن أو الجلد. تتراوح بين العزل والضرب والحرمان من الناس والهواء. وأحيانا تقترن بالقتل، المغطّى بذريعة “الشرف”. و”المخفّفة” عقوبته بحكم القانون. وكلها عقوباتٌ “صامتة”. قليلاً ما نسمع عنها، ولا نقشعها. لأنها تقع في دائرة خاصة مغلقة. والعائلة، البيئة، العشيرة، الطائفة، لا بل الشلّة أحياناً .. هذه كلها قوانينها أكثر مكراً من قوانين الدولة، أقلّ رحمة. وإطاعتها لا تحتاج إلى كلمات. تكفيها الإشارات والنبْرات والترحيبات أو مجرَّد عادات. أما الدول التي تلزم بالحجاب قانونياً، فلا غموض ولا التباسات. عقوبة السفور عندها علنية، منصوص عليها. وتشكّل أحياناً مادة إعلامية مثيرة. خلع الحجاب في هذين المحيطَين، الضيق الواسع، يتطلّب درجة عالية من الشجاعة، وأحيانا التهور. ومهما كانت دوافعه عميقة، أو مجنونة، فإن هذا الخلع يمثل، موضوعياً، أعلى درجات التمرّد على قانون يرينَه خانقاً. في الضفة الأخرى ماذا تجِد؟ دول توسّلت السفور، في لحظةٍ من لحظاتها، في حربها على خصوم الداخل. على هذا الخط مثلاً، مشى حافظ الأسد وشقيقه رفعت، في ثمانينيات القرن الماضي، من دون أن يكون السفور قانوناً اجتماعياً لسورية، ولا العلمانية جذورها. عندما أنزلَ قواته المسلحة إلى قلب دمشق، لتنزع حجاب النساء المارّات، بشراسة متناهية، أمام أعين الجميع، في الأزقة والشوارع والساحات. وكان الأسد وقتها في حرب ضد الإخوان المسلمين، يريد أن يقول إنه، مثل الدول الغربية العلمانية، بذلك “يحارب التخلّف”. ثم دول في أيامنا هذه، السفور عندها من المسلَّمات: الفرنسيون، بعدما أعادت لهم مشاريعهم الاستعمارية الغابرة حوالي خمسة ملايين مسلم. وقد صار هؤلاء فرنسيين بحكم القانون، والأميركيون ومهاجروهم المسلمون، فباتَ على الاثنين سنّ قوانين. تشدّد الفرنسيون، والسجال ما زال دائراً بينهم، حول توسيع النطاق الذي يُسمح فيه بلِبْس الحجاب أو تضييقه. والأميركيون انتقدوهم. اعتبروهم أكثر “يعقوبيةً” مما يجب. فهم رغم “11 سبتمبر”، لم يضيفوا شيئاً على الحجاب والسفور. وبقي ظاهرة “عادية”. وإن كان المجتمع والمؤسسات ورجال الأمن في المطارات يمارسون تجاه المحجّبات نوعاً من الاضطهاد البيروقراطي واللئيم في أكثر المواقف استضعافاً لهن. في كل الأحول، فرنسا أو الولايات المتحدة، كلٌ بحسب ثقافته السحيقة، وتاريخه مع الدين، وتطوّر العلاقة بين دولته وكنيسته. وإسقاط هذين، الصراع والتاريخ، على جسد النساء. ثمْة دول توسّلت السفور، في لحظةٍ من لحظاتها، في حربها على خصوم الداخل هكذا، في لبنان، ما من قانون يفرض الحجاب. ولكن الواضح، الطبيعي، أن مُسلمات يلْبسْنه. البيئات والطوائف والعائلات، ومؤسّسات بعينها هي التي تنْزله على نسائها، بقوانين غير منصوصة. وعقوبتها أشدّ قسوة من قيود فرنسا والولايات المتحدة. ولكن أيضاً، ثمّة بيئات وطوائف وعائلات ومؤسّسات، لا تقبل بالمحجبات بين صفوفها، إلا كزبائن. لذلك، عندما ضجّت وسائل الإعلام ومواقع التواصل بقرار طرد موظفة من “الكافيه” الذي تعمل فيه، “بسبب حجابها”، جلّ الأصوات المستنكرة كانت تدين القرار وتعتبره من إرهاصات التقسيم، المعروف بـ”الفدْرلَة”، المنبوذة على كل لسان، فكل شعب يعبّر عن الثقافة التي بناها نظامه السياسي. الفرنسيون، الأسد، الأميركيون، والآن، النظام الطائفي اللبناني. الفرنسيون علمانيون متطرّفون، الأسد علماني مزيّف، الأميركيون دعاة ليبرالية اجتماعية، فيما اللبنانيون لا يستطيعون أن يروا غير الطوائف من وراء الحجاب. لا يرون في الحجاب، وصنوه السفور، غير “فتْنة” التقسيم الطائفي. ولكن الذي يجمع بين أطراف هذه الضفة الأخرى، هو عكس تماماً ما يجمع أطراف الأولى: كل من تتجرّأ على مخالفة الحلقة الضيقة أو الواسعة، وتخلع الحجاب، مكتوبٌ عليها نوع معين من القصاص. أدواته تتراوح بين التلميحات والحرمان من لقمة العيش مروراً بالحرمان من العريس (كما يمكن أن يكون الوضع معكوساً، أي ارتداء الحجاب بدافع إيجاد عريس). الآن. ما الموقف الصحّ الممكن تبنّيه في هذه الحالة، أو الحالتين؟ وذلك بصرف النظر عما إذا كنا مع الحجاب أو ضده. نراه فريضةً شرعية أو لا نراه. نلْبسه أو لا، أو عند الاضطرار، مقابلة مع شيخ أو دخول مسجد .. ما الموقف؟ من تكون المظلومة؟ مع من أتعاطف؟ مع المحجَّبة؟ مع السافرة؟ ليس هناك من جواب بسيط على السؤال. المعيار، كما نرى، هو “موازين القوى”. القوانين المكتوبة والهامِسة. في الحالة الأولى: الراغبة بخلع حجابها، ومهما كانت أسبابها، بوجه آلة قمعية متعددة الألوان، ومتفاوتة الامتداد… هذه المرأة، لا بد مهدورة الحقوق. تجد نفسها في السفور لا الحجاب. في الحالة الثانية: اللابسة الحجاب، أو الراغبة به، أو المفروض عليها، بتنوّع أسبابها، وكلها جديرة. والمطلوب منها أن تخلعه. هذه المرأة أيضا يقع عليها اضطهاد. اطمئنانها إلى حجابها، بالإكراه أو بالمغريات، أو مجرّد الإيمان به.. أسباب كافية للتعاطف معها. تتقلّب موازين القوى في كلتا الحالتين. في الأولى، المظلومات، وربما المحرومات، هن اللواتي يخلعن الحجاب. وفي الثانية هن اللواتي يلْبسنه. لن يتوقف موضوع الحجاب عن إثارة السجالات والتعليق والشجب والتأييد، وكل مرة بدفعة ودوافع جديدة، وبجيلٍ آخر من السافرات والمحجّبات بكل الأحوال، “السجال” حول الحجاب لن ينتهي. سوف يهبط ويصعد.. بما تتكفّل به الدول والمجتمعات من توليد الوقائع. وهذه الأخيرة مرشَّحة للتكاثر. لماذا؟ لأن زمننا يشهد على حضور اتجاهين، يتناقضان من حيث المبدأ. الأضعف هو الأول، الاتجاه الديني، بالمعنى الثقافي – السلوكي، الذي لم يَعُد مرتبطاً بالضرورة بتنظيم سلفي أو بـ”الإخوان المسلمين”. والثاني، الاتجاه النسوي الذي يرفع كل يوم بعدا آخر من درجة انغماس نساء العالم في شؤونٍ كانت في الماضي بعيدةً عن منالهن. شؤون “الخارج” أقصد. والمُسْلمات من بينهن لسن هن الأكثر حضوراً أو عدداً. ولكنهن آخذات طريقهن إلى النمو. يعملن، يتعلّمن، يتسيّسن، يتبضّعن، يقفن في طوابير الخبز والغاز كما يغنّين ويرقصن، وتصعد نجوميتهن على تطبيق “التيك توك” .. إلى ما هناك من أنشطة جديدة. وهذه الأخيرة، أي الأنشطة، ليست حكراً على السافرات. المحجّبات جزء منها. حتى في الغناء. أيضاً: تطورت في عالمهن الفكري حركة، عنوانها “النسوية إسلامية”. لها نظرياتها وأطروحاتها ومؤتمراتها وشخصياتها، وفي بعض الأمكنة أيقوناتها؛ من منظّرات وعالمات، إلى داعيات يعِظن ويقُدْن الصلاة، وسيدات أعمال، ومديرات
