“الاستهزاء بالإسلام”، يؤكد الباحث الجزائري سعيد جاب الخير في مقابلة مع المانيا اليوم عربية أن الحكم “سيفتح باب جهنم في البلد وسينقل النقاش الفكري إلى ردهات المحاكم”، لكنه يتمسك بآرائه ويقول إنها معطيات تاريخية وليست فتاوى. وفيما يلي نص الحوار مع الباحث جاب الخير: المانيا اليوم عربية: أدانتك المحكمة بثلاث سنوات حبسًا نافذًا، ما تفاصيل هذا الحكم؟ سعيد جاب الخير: لست مخولًا للحديث في الجانب القانوني، لكن باختصار استغربت كثيرًا لهذا الحكم أن يكون بهذه الدرجة من الشدة. الحكم صحيح أنه نافذ لكن منطوقه لا يحمل الإيداع في السجن. الحكم صدر دون نطق بلفظ الإيداع ولذلك أنا الآن حر وأعد رفقة الدفاع للاستئناف. آراء كثيرة مثيرة للجدل أدليت بها، منها ما يخصّ أن الحج كان شعيرة وثنية وأن صيام رمضان كان اختياريا، وهو ما أوله الطرف المشتكي على أنه استهزاء من الدين. ما رأيك؟ الطرف المشتكي ومحامون يأولون كلامي، هم لا يقفون عند حدود ما أقول، بل يدخلون في النية عبر قولهم يقصد كذا وكذا. بخصوص الحج، أنا تكلمت عن الحج في منظوره التاريخاني. قلت إنه شريعة قديمة موجودة قبل الإسلام وكان عدد من طقوسها كالسعي بين الصفا والمروة كانت تمارس أولا في إطار وثني، وهذا الأمر مذكور في سورة البقرة الآية 158 وفي سورة الحج الآية 67 ومذكور في تفاسير القرآن. أنا نقلت ما هو موجود فقط. لذلك تحرج المسلمون في قضية الصفا والمروة من ممارسة هذه الشريعة وقالوا للرسول إنهم كانوا يمارسونها قبل الإسلام. كما أنه قبل الهجرة النبوية كذلك، الرسول نفسه كان يصلي في الكعبة وكانت لا تزال فيها الأصنام التي لم يتم إزالتها من الكعبة إلا يوم الفتح. بخصوص الصيام، أنا سُئلت في برنامج تلفزي حول بعض الشباب الذين يلاحقون أمنيًا في رمضان، وأجبت أن الصيام بدأ بشكل اختياري في الإسلام وهو ما يؤكده التفسير الشائع للآية 184 من سورة البقرة. كل التفاسير بدون خلاف تقول إن الصحابة كانوا يصومون رمضان بشكل اختياري. ومن لم يكن يريد أن يصوم بلا سبب (عذر شرعي) كان يُخرج الفدية. هل الأمر يتعلّق بفتوى منك؟ لا أبدًا. ليس لي حق الفتوى وهي منصب رسمي. الناس أولوا كلامي على أنه فتوى، بينما مثلاً في الصيام قدمت قراءة تاريخانية لهذه الشريعة. أنا أصلا لا أؤمن بالفتوى وأرفض منطقها، كما أتحدث بوصفي باحثًا مختصًا في الشريعة بينما المشتكي ومن معه ليسوا مختصين. لماذا ترفض منطق الفتوى؟ لأنه يفرض الوصاية الدينية على الناس. يجب أن نخرج إلى فضاء آخر أي أن نصل إلى وجود المختص في المجال الذي يعطي المعلومة والتحليل، بينما يملك المسلمون العقول ويمكنهم اختيار ما يرونه صالحا لأنفسهم. هناك آراء أخرى كذلك ترى أن الوحيد الذي له حق الفتوى هو الله. لكن حتى الدول الإسلامية الأكثر انفتاحًا لديها مجالس رسمية للفتوى وهو أمر يدافع عنه الكثير من الناس تجنبًا لفوضى الفتاوى؟ نعم لكن الفتوى عمومًا أمر تقليدي. في منطقي كباحث، عصر الفتوى انتهى. يجب أن نقوم بتكوين باحثين يعطون المعلومة والتحليل للمسلمين الذي يختارون. كما يجب على هؤلاء الباحثين إعطاء المعلومة بأكملها بدل كتمانها، لذلك انزعج عدد منهم عندما تحدثت عن تاريخانية الصيام. منطق الكتمان لم يعد ينفع لأن المصادر موجودة على الانترنت. من الآراء الأخرى التي أثارت الجدل ما دعوت إليه من تنظيم الموسيقى في المساجد؟ أنا قلت بالحرف “أتمنى أن تخرج المساجد من روتينها التقليدي”. هل تعلم أن بعض المساجد في منطقة القبائل تقام فيها عروض مسرحية وسينمائية خارج أوقات الصلاة؟ يمكن للمسجد أن يكون كذلك مركزًا ثقافيًا تعرض فيه الفنون. يقدم جاب الخير نفسه باحثا متخصصا في الشريعة، لكن آراءه تثير جدلا واسعا داخل الجزائر وخارجها لكن هناك آراء أخرى تقول بعدم إمكانية هذا الأمر من الناحية الدينية في الإسلام؟ هناك خلاف في الموسيقى، هناك فقهاء يجيزونها منهم ابن حزم الذي يرفض كل الأحاديث التي تحرّم الموسيقى. الإمام الغزالي له الموقف ذاته. شخصيًا لا أعتقد بوجود تحريم للموسيقى. وما دامت حلالًا فما المانع أن تقام في المساجد؟ تقول إن من يهاجمونك هم الوهابيون السلفيون الذين يتبعون طريقة تدين غريبة عن التدين الذي عُرفت به الجزائر؟ صحيح. يجب أن نعلم أن الوهابية مستوردة. دخلت الجزائر في العشرينيات كما تؤكد على ذلك المصادر. طيب وأيّ طابع يغلب على التدين في الجزائر؟ يغلب عليه الطابع الوهابي إعلاميًا، أغلب القنوات والمواقع التي تؤطر الرأي العام دينيًا هي ذات توجه وهابي. الشعب الجزائري في أغلبيته العددية هو محافظ وليس وهابي. لكنه يتعرض لتأثير وهابي كبير بسبب هذه القنوات. الدعوى المرفوعة بحقك رفعها طرف مدني وليس النيابة العامة. هل نحن أمام سابقة تؤسس لفتح المجال أمام المواطنين لمحاكمة الباحثين الدينيين؟ هذه القضية بالتحديد ستفتح أبواب جهنم على البلد. كل من ينزعج من شخص يتحدث في تخصصه سيذهب ليودع ضده شكوى. هكذا ستتحوّل العدالة إلى فضاء لنقاش الأفكار وليس لقضاء مصالح الناس وحلّ نزاعاتهم القانونية. النقاش الفكري مكانه وسائل الإعلام والجماعات والمراكز الثقافية وليس المحاكم. هل هناك خوف من تقوّي التيار المتشدد بعد الحراك في الجزائر خصوصًا أن دولا شهدت حراكات وثورات عرفت ظهور بعض التيارات السلفية المتشددة كما وقع في تونس في السنوات الأولى ما بعد الثورة؟ نعم شخصيًا أشعر بهذا سواء كباحث أو كمواطن. لكن تغوّل هذه التيارات المتشددة توّسع في عهد عبد العزيز بوتفليقة. الظاهرة بدأت تحديدًا في عهد الشاذلي بن جديد الذي جاء بالإخوان من الشرق وشجعهم على المنابر والتغلغل في الجامعات منذ مطلع الثمانينيات، لكن التيار تغوّل أكثر في عهد بوتفليقة. أنت تنتقد بشكل كبير كتب الفقه وخاصة “صحيح البخاري” و”صحيح مسلم” وتقول إن هناك أحاديث غير منطقية رغم أن هذه الكتب لديها أهمية كبيرة في النسق الديني الإسلامي. لماذا؟ المتون التراثية والخطاب الديني التقليدي وكتب التراث سواء فقهية أو تفسيرية أو غيرها تحتاج إلى غربلة وقراءة جديدة. هذه الكتب تحتوي على الكثير من النصوص التي لا يمكن قبولها وهي مضادة للمنطق وللعقل وللعلم وللكثير من مفردات الواقع وللقيم الإنسانية والحضارية التي يُجمع العالم والمجتمع الإنساني عليها. لا يمكن للمسلمين العيش بسلام والمحافظة على العيش المشترك مع بقية العالم من غير المسلمين إذا استمروا بتشبثهم المتعصب بتلك المفردات القديمة وعدم مراجعتها. كتاب “صحيح البخاري” مثلاً فيه أحاديث لا يمكن القبول بها اليوم ومضادة تمامًا للمنطق الذي يفكر به المسلم وغير المسلم. هناك أشياء يجب إعادة النظر فيها وتجديد قراءتها حتى تتلاءم مع العصر ولكي لا تجعلنا في تناقض مع المجتمعات الأخرى. أجرى الحوار: إسماعيل عزام 44
