BBC / أخلت السلطات المصرية سبيل فتاة متحولة جنسيا، احتجزت منذ مارس/آذار الماضي، بسبب منشورات معارضة على موقع فيسبوك، وسط انتقادات لتعامل السلطات معها في مرحلتي الاستجواب والاحتجاز.
وأكدت هدى نصر الله محامية ملك الكاشف، المعروفة بنشاطها في مجال الدفاع عن حقوق المتحولين جنسيا في مصر، تنفيذ أمر إخلاء السبيل في ساعة مبكرة من صباح اليوم الثلاثاء.
وقررت نيابة أمن الدولة إخلاء سبيل الناشطة البالغة من العمر 19 عاما بضمان محل إقامتها على ذمة التحقيقات التي تجري معها، وتم تنفيذ أمر إطلاق سراحها من قسم شرطة الهرم جنوبي العاصمة المصرية.
وجاء قرار السلطات المصرية بعد ثلاثة أسابيع من تقدم 33 منظمة معنية بحقوق الإنسان بالتماس لمقرري الأمم المتحدة وأعضاء البرلمان الأوروبي، وممثلي البرلمانات الوطنية في الاتحاد الأوروبي، يدعو إلى التدخل العاجل والتواصل مع السلطات المصرية للإفراج عن الناشطة المحبوسة في ظروف احتجاز وصفوها بـ “غير المناسبة لحالتها”.
وجاء في الالتماس أن ملك في مرحلة عبور لإعادة تعيين نوع الجنس، تحت إشراف طبي بموافقة اللجان الحكومية المختصة، وتتطلب هذه المرحلة رعاية بدنية ونفسية مستمرة، كما تتطلب الحالات المماثلة تعاملا مختلفا من السلطات، حال استجوابهم أو إيداعهم مقار الاحتجاز.
وأثار احتجاز الكاشف، التي لا تزال مقيدة كذكر في الأوراق الثبوتية، جدلا بشأن التعامل مع حالات المتحولين جنسيا في أماكن الاحتجاز.
كانت السلطات قد ألقت القبض على ملك في مارس/ آذار الماضي، بعد دعوتها في منشور على فيسبوك للتظاهر ضد الحكومة، في أعقاب حريق شهدته محطة السكك الحديدية بالقاهرة، في فبراير/ شباط الماضي، وأدى إلى مقتل وإصابة العشرات.
وخضعت الكاشف للاستجواب، على خلفية اتهامها باستخدام حسابها على فيسبوك في بث دعايات يعاقب عليها القانون.
وبموجب قانون مكافحة الجرائم الإلكترونية المصري، قد تصل عقوبة نشر أخبار كاذبة على وسائل التواصل الاجتماعي إلى السجن لمدة عامين، بالإضافة إلى غرامة قد تصل قيمتها إلى مئة ألف جنيه مصري.
وألقي القبض على ملك الكاشف، بالتزامن مع القبض على شاب آخر متحول جنسيا من أنثى إلى ذكر، يدعى حسام أحمد.
ووجهت النيابة لهما تهمتي الانضمام لجماعة إرهابية، واستخدام حساب علي موقع التواصل الاجتماعي فيسبوك، للإخلال بالنظام العام.
ونقلت وسائل إعلام محلية ووكالة الأنباء الفرنسية، حينذاك عن مصادر أمنية أن الفتاة محتجزة في سجن انفرادي، “ليس مع الرجال أو النساء”.
وكانت الكاشف، التي خضعت لعملية تحول جنسي من ذكر إلى أنثى قبل عامين، قد تحدثت خلال الأعوام الماضية، عبر وسائل التواصل الاجتماعي عما تعرضت له من “عنف أسري و اضطهاد”، بسبب رغبتها في تغيير جنسها، إذ لا يزال أغلب المجتمع المصري ينظر لإضطراب الهوية الجنسية كمسألة أخلاقية لا مرضية.
ولا يوجد في القانون المصري حتى الآن مواد لتنظيم مسائل التحوّل الجنسي، وكيفية التعامل معها.
