فجأة متاعب قانونية في وطنهم الأصلي، لأنهم في نظر قوانين دولتهم الأولى ما زالوا مواطنين يخضعون لها. فقوانين إصدار جوازات السفر متنوعة بتنوع الدول التي تصدرها. قانون الجنسية في جمهورية ألمانيا الاتحادية يضع المواطن أمام خيار وحيد: إما الجنسية الألمانية وإما جنسية بلد آخر. ما يعني أن من يحمل الجنسية الألمانية لا يجوز له الاحتفاظ بجنسية بلد آخر. بعبارة أوضح: الأجنبي الذي يتقدم بطلب للتجنس بالجنسية الألمانية، عليه التخلي عن جنسية بلده الأصلي، وفق المادة العاشرة من قانون التجنسية الألماني. هذا ما يتعلق بالمبدأ الأساسي للتجنس، لكن القانون يسمح باستثناءات أيضا ويخفف قيوده في بعض الحالات: مثلا هناك إسقاط جنسيتها إطلاق عن مواطنيها. في نفس الوقت لا يستطيع أحد تجنب اكتساب الجنسية الإيرانية، فالقانون ينص على أن كل من يكون والده إيراني الجنسية هو أيضا إيراني الجنسية، وذلك بغض النظر عن مكان ولادته والبلد الذي يعيش فيه. وهناك فقرة في قانون الأحوال المدنية الإيراني يعقد الأمور بشكل خاص بالنسبة للنساء الإيرانيات اللواتي يرغبن في الحصول على جنسية بلد آخر. فالنساء عليهن حمل الجنسية التي يحملها الزوج. وعلى هذا الأساس يتم قبول مبدأ ازدواجية الجنسية بشكل مستمر، عندما يتقدم الإيرانيون المقيمون في ألمانيا بطلب الحصول على الجنسية. وحسب بيانات المكتب الاتحادي للإحصاء، فإن حوالي 3080 إيرانيا قدموا العام الماضي طلبا لنيل الجنسية الألمانية، حيث حصلوا عليها جميعا دون أن يسقط أي منهم جنسيته الإيرانية. وللعلم، فإن إيران ليست البلد الوحيد الذي يرفض إسقاط الجنسية عن مواطنيه. فهذه الحالة نجدها في 40 بلدا آخر، بينها الأرجنتين. وقدم العام الماضي حوالي 155 أرجنتينيا يعيشون في ألمانيا طلبا لنيل الجنسية الألمانية، حيث احتفظوا جميعا دون استثناء بجوازات سفر بلدانهم الأصلية. ولكن هناك دول لديها قوانين جنسية صارمة مثل أفغانستان وإريتريا ونيجيريا وسوريا. حق الدم مقابل حق الإقليم هناك مبدآن يتحدد بموجبهما قرار منح الجنسية لشخص ما: الولايات المتحدة على سبيل المثال، تمنح الجنسية وفق مبدأ الإقليم، ويسمى في الولايات المتحدة “Jus Soli”. ما يعني أن كل الأطفال الذين يلدون فوق أراضي الولايات المتحدة الأمريكية يحصلون تلقائيا على جنسيتها. كما يحصل أطفال المواطنين الأمريكيين الذين يلدون خارج الولايات المتحدة على جنسية الوالدين الأمريكية. من جانب آخر، تنتهج ألمانيا والصين مبدأ آخر في سياسة التجنس. فالدولتان تعتمدان مبدأ “Jus Sanguinis” أي مبدأ “حق الدم”. والمقصود بذلك هو الأصل، أي أن ألمانيا لا تمنح جنسيتها على الولادة على أراضيها، كما هو الحال في الولايات المتحدة، وإنما تمنح جنسيتها على أساس حمل أحد الوالدين بالجنسية الألمانية. لكن حق الدم ليس هو الطريق الوحيد للحصول على الجنسية الألمانية، إذ يسمح قانون الجنسية الألمانية بالتجنس للمقيميين على أراضيها لفترة زمنية محددة وتوفر الشروط الأخرى اللازمة. كما يسمح القانون الألماني في حالات استثنائية بازدواجية الجنسية. أما الصين فتصعب إلى حد كبير تجنس مقيميين فيها من إثنيات أجنبية. أما ازدواجية الجنسية، فيمنعها القانون الصيني جملة وتفصيلا. الأوروبيون ونعمة تعدد الجوازات أما بالنسبة إلى وضع الأوروبيين في دول الاتحاد الأوروبي، فإنه مختلف تماما. فألمانيا سمحت في عام 2007 لكل مواطني دول الاتحاد الأوروبي وسويسرا بالتجنس لديها، رغم أن الحكومة الألمانية لا تفضل مبدأ ازدواجية الجنسية، حيث يحتفظ كل المجنسين الجدد في المانيا من مواطني دول الاتحاد الأوروبي بجوازات سفر بلدانهم الأصلية. كما تسمج بقية دول الاتحاد الأوروبي بازدواجية الجنسية إما بشكل كامل أو فقط في حالات استثنائية. وأظهرت إحصائية للسكان أن قرابة 4,3 مليون شخص في ألمانيا يحملون إلى جانب الجنسية الألمانية المكتسبة جنسيات دول أخرى. فحوالي 690 ألف مواطن يحملون إلى جانب جنسيته الألمانية الجنسية البولندية ايضا. وهناك أيضا 570 ألف مواطن يحملون الجنسية الروسية وقرابة 530 ألف يحملون الجنسية التركية إلى جانب الألمانية، وفق الأرقام التي نشرها المكتب الاتحادي للإحصاء. لكن هذه الأرقام تبقى نسبية وغير مؤكدة تماما، لأن الكثيرين من المواطنين ينسون أن لهم حق الاحتفاظ بجنسية بلدهم الأصلي أو ينسون ذكر تخليهم عن الجنسية الأصلية لدى الدوائر الرسمية. يسمح القانون الألماني للإيرانيين بحمل جوازين للسفر- إيراني وألماني حق الاختيار بين جنسيتين تجدر الإشارة إلى أنه وحتى نهاية عام 2014 كانت ألمانيا تتميز بأمر نادر: وهو أنه كان يفرض على الشباب ما بين سن 18 و23 عاما ممن ولدوا في ألمانيا من أبوين أجنبيين وترعرعوا فيها أن يختاروا بين جنسيتين، جنسية الوالدين الأصلية أو الجنسية الألمانية. وكان ذلك يتعلق بالشباب من أصول تركية بالدرجة الأولى. لكن ومنذ نهاية 2014 لم يعد يجب على هؤلاء الذين أنهوا عامهم الحادي والعشرين في ألمانيا، وقضوا منها ثمانية أعوام في ألمانيا أو دخلوا المدرسة لمدة ست سنوات، الاختيار بين إحدى الجنسيتين. فقد سقط مبدأ الاختبار بين الجنسيتين لكل من أنهى التعليم المدرسي أو تأهيلا مهنيا في ألمانيا. وبات منذ ذلك الحين من حق هذه الشريحة من المواطنين، وجلهم من أصول تركية، حمل الجنسيتين التركية والألمانية معا. خصوصية العلاقة الإسرائيلية ـ الفلسطينية في الشرق الأوسط، وخصوصا في حالة إسرائيل والمناطق الفلسطينية، هناك خصوصيات متعددة فيما يخص قانون الجنسية. واحدة من هذه الخصوصيات تشمل العلاقة بألمانيا: فهناك مواطنون ألمان يحملون جواز سفر ألماني ومسجلين في نفس الوقت لدى السلطات الفلسطينية كمواطنين لهم وثائق رسمية ولكن لا يجوز لهم دخول الأراضي الإسرائيلية، رغم حملهم لجواز سفر ألماني. ولا يسمح لهؤلاء بالسفر إلى مناطق الضفة الغربية إلا عبر الأردن. وفي حال عدم امتلاكهم لجواز سفر فلسطيني، يتم تسجيل رقم وثيقتهم الفلسطينية في جواز السفر الألماني ويطالبون باستصدار جواز سفر فلسطيني. وفي إسرائيل هناك قانون لا يزال ساريا حتى اليوم منذ عام 1950 وبعد عامين من تأسيس الدولة الإسرائيلية، وحيث كانت ذاكرة المحرقة مازالت طرية في أذهان الناس، أصدرت إسرائيل قانونا يسمح لكل يهود العالم بالهجرة إلى إسرائيل واكتساب الجنسية الإسرائيلية فورا. وحسب القانون، فإن اليهودي هو من تكون أمه يهودية أو من اعتنق الديانة اليهودية بشكل موثوق. وفي الآونة الأخيرة استفاد الكثير من يهود فرنسا من
