للمرة الأولى في العالم وتُوجَّه إليهما تهمة ارتكاب جريمة ضد الإنسانية
في المحاكمة الأولى في العالم تتناول انتهاكات منسوبة للنظام السوري، يمثل ضابطان في الاستخبارات السورية، أمام القضاء الألماني، اعتباراً من الخميس 23 أبريل (نيسان).
وتُوجَّه إلى المشتبه فيه الرئيس العقيد السابق في جهاز أمن الدولة أنور رسلان (57 سنة) تهمة ارتكاب جريمة ضد الإنسانية.
ويتّهمه القضاء الألماني بالمسؤولية عن مقتل 58 شخصاً وعن تعذيب ما لا يقل عن أربعة آلاف آخرين من أبريل 2011 إلى سبتمبر (أيلول) 2012، في فرع الخطيب الأمني، الذي كان يديره في دمشق.
وانشق رسلان، وفقه، في أواخر 2012، وتفيد وسائل إعلام بأنه انضم إلى صفوف المعارضة في المنفى قبل أن يصل إلى ألمانيا في 26 يوليو (تموز) 2014، وهو يواجه عقوبة السجن المؤبد.
أما المتهم الثاني، أياد الغريب (43 سنة)، فتوجه المحكمة إليه تهمة التواطؤ في جريمة ضد الإنسانية لمشاركته في توقيف متظاهرين، اقتيدوا إلى السجن ذاته بين الأول من سبتمبر و31 أكتوبر (تشرين الأول) 2011.
والرجلان موقوفان قيد الحبس الاحترازي منذ 12 فبراير (شباط) 2019.
الوسيلة الوحيد
وتجري المحاكمة في ألمانيا عملاً بمبدأ “الولاية القضائية العالمية” الذي يسمح لدولة ما بمقاضاة مرتكبي جرائم ضد الإنسانية بغض النظر عن جنسيتهم أو مكان وقوع جريمتهم.
وفيما تُحاط محكمة كوبلنس بتدابير أمنية مشدّدة، اعتبر فولفغانغ كاليك، الأمين العام لـ”المركز الأوروبي للحقوق الدستورية وحقوق الإنسان” المنظمة غير الحكومية الألمانية، أن المحاكمة “خطوة مهمة وبداية النظر في جرائم (النظام السوري) أمام محكمة عليا ألمانية”.
ويُتوقع أن تستمر المحاكمة حتى منتصف أغسطس (آب) على أقرب تقدير.
وقدم كاليك الدعم إلى 16 من الضحايا السابقين، بعضهم أطراف مدنيون في الدعوى.
ومن المدعين، المحامي السوري والناشط في مجال حقوق الإنسان في وطنه أنور البني المقيم في ألمانيا كلاجئ منذ نحو خمس سنوات.

وترى منظمات غير حكومية أن هذه المحاكمة هي الوسيلة الوحيدة لمقاضاة مسؤولين، لأن رفع أي قضية إلى المحكمة الجنائية الدولية مستحيل بسبب استخدام روسيا والصين حق النقض (الفيتو).
واستند المحققون إلى إفادات ضحايا عانوا من شروط اعتقال “لا إنسانية ومذلة” بحسب القضاء وتمكّنوا من الوصول إلى أوروبا.
الأسد ينفي التعذيب
ووفق النيابة العامة، فإنّ المعتقلين في سجن الخطيب الذين شارك عددٌ كبيرٌ منهم في التظاهرات المطالبة بالحرية والديمقراطية التي شهدتها سوريا في سياق تحركات “الربيع العربي”، اعتباراً من مارس (آذار) 2011، تعرّضوا “للكمّ والضرب بالعصي والأسلاك والجلد” وخضعوا لـ”الصعق بالكهرباء”.
وتضيف أن معتقلين عُلّقوا بمعصمَيْهم “بحيث لا يلامسون الأرض إلّا برؤوس أقدامهم” و”استمرّ ضربهم في هذه الوضعية”، مشيرةً إلى “حرمانهم من النوم لأيام عدّة”.
وجاء في بيان الاتهام أن “وسائل التعذيب الجسدية والنفسية الوحشية” كانت تهدف إلى انتزاع “اعترافات ومعلومات حول المعارضة”.
ولفت كاليك إلى أن المتهم الرئيس “ليس حارساً بسيطاً لسجن، بل هو شخص تولّى بحسب النيابة العامة مهام إدارية” في جهاز الدولة السورية.
غير أن بشار الأسد نفى، رداً على سؤال عن محاكمة رسلان حصول أي أعمال تعذيب، في مقابلة أجرتها معه شبكة “آر تي” الروسية القريبة من الكرملين في نوفمبر (تشرين الثاني) 2019.
وقال الرئيس السوري الذي يحكم البلد منذ عشرين عاماً، “إنّنا لم نعتقد يوماً أن التعذيب يمكن أن يجعل وضعنا أفضل كدولة، بمنتهى البساطة. لذلك لا نستخدمه”.
لكن المرصد السوري لحقوق الإنسان يؤكد وفاة ما لا يقل عن 60 ألف شخص تحت التعذيب أو نتيجة ظروف الاعتقال المروعة في سجون النظام السوري.
