تزداد المواجهة الساخنة سخونة صيف هذه السنة، بين السلطة والمعارضة حول طبيعة نظام الحكم في “الجزائر الجديدة”، إلى تعطيل تمرير مسودة الدستور على البرلمان وإفشاله على مستوى الاستفتاء الشعبي، وهو ما دفع الحكومة إلى “نثر” حديث هنا وهناك بأن استفتاء تعديل الدستور لم يعد أولوية.
معارضة تطالب بنظام برلماني
وجاء تمسك أحزاب سياسية معارضة بنظام برلماني يسمح للحزب الفائز بالانتخابات البرلمانية بتشكيل الحكومة، أمام سلطة “تفرض” نظاماً شبه رئاسي، ليفتح أبواب صراع قديم جديد حول طبيعة نظام الحكم الذي يلائم الجزائر. وقالت التشكيلات المعارضة وعلى رأسها “حركة مجتمع السلم”، إن تمسكها بخيار النظام البرلماني يرجع إلى التجارب السيّئة للنظام الرئاسي الذي قاد البلاد إلى انحراف وحالة من الحكم الفردي. وأوضحت أن النظام شبه الرئاسي الذي تقترحه السلطة في مسودة الدستور الجديد، لا يحتوي على الضمانات الكافية لتطبيقه بشكل جيد، وحذرت من مغبة صياغة دستور ينحاز إلى مقترحات الأقلية السياسية، التي تبحث عن التموقع.
كما أشار “حزب طلائع الحريات” إلى أن “الجزائر الجديدة” تحتاج إلى دستور يختلف كلياً عن الدساتير السابقة، التي كانت تتضمن تسلطاً وشمولية وانفراداً بالقرار السياسي، وصياغة دستور يتضمن منح حق تشكيل الحكومة وجوباً لحزب الغالبية البرلمانية، واسترجاعاً لصلاحيات رئيس الحكومة بشكل كلي، وتقاسماً عقلانياً للصلاحيات بين رئيسي الحكومة والجمهورية، وجعل الحكومة مسؤولة أمام البرلمان، ودعم دور المجلس الأعلى للقضاء وصلاحياته واستقلالية العدالة، وتدعيم سلطات البرلمان.
نظام “رئاسوي”؟
وبحسب البرلماني السابق والناشط السياسي خوجة الأرقم، فإن المشكلة ليست في طبيعة النظام السياسي الأجدى، وإنما في عدم صدق النظام في تبني أي شكل من أشكال الأنظمة السياسية المتعارف عليها.
وأوضح في تصريح لـ”اندبندنت عربية”، أن النظام يريد تمرير النظام “الرئاسوي” تحت شعار النظام شبه الرئاسي، وهو نظام مفرط في الرئاسي بحيث يكون أقرب إلى نظام إمبراطوري، يكون فيه الرئيس متحكماً في كل جوانب الحياة السياسية، في مقابل نظام شبه رئاسي له أركانه، ومنها حق الغالبية في تشكيل الحكومة. وختم أن الذين يطالبون بالنظام البرلماني يعتبرونه الأنسب في مراحل الانتقال الديمقراطي.
السلطة “تفرض” شبه الرئاسي
وكان الرئيس عبد المجيد تبون قد أكد في تصريحات عدة، أن الجزائر تتوجه نحو نظام شبه رئاسي بصلاحيات واسعة للبرلمان لغلق المنافذ أمام الحكم الفردي، مستدلاً بتنازله عن عدد من صلاحياته لصالح رئيس الوزراء. ورأى أن “النظام شبه الرئاسي قد يكون الأنسب مع مراعاة خصوصيتنا”، مجدداً رغبته في الخروج من النظام الرئاسي الصلب الذي يتحكم فيه شخص واحد وينفرد فيه بالسلطة، وأبدى تحفظه على النظام البرلماني، الذي “يجب بناؤه على أسس صحيحة، ويحتاج إلى ثقافة سياسية تكون وليدة المجتمع”.
كما أكدت الرئاسة على لسان المستشار المكلف بمسودة الدستور سابقاً، محمد لعقاب، أن بنية النظام السياسي لن تكون موضع نقاش أو مزايدة، وستُرفض كل المقترحات بشأنها، كما هو الأمر بالنسبة لثوابت الهوية وتاريخ الجزائر، وقال إن الرئيس تبون يرغب في إقرار دستور يضمن التوازن بين السلطات، ويعبر عن تطلعات الجزائريين وطموحاتهم، في تنظيم الحياة السياسية والعامة بمنع تكرار ثغرات قانونية أدخلت البلد سابقاً في أزمة سياسية وقانونية حادة. وأضاف أن لجنة الخبراء التي أعدت المشروع التمهيدي للدستور استفادت من تجارب الدساتير في الدول الأخرى، على سبيل المثال تونس، واعتمدت مقاربة محلية معقولة يتم استنباطها من خلال الممارسة والصلاحيات الممنوحة لكل سلطة.
وفي السياق ذاته، أعلن المجلس الدستوري عن دعمه حزمة تعديلات دستورية تبرز الفصل والتوازن بين السلطات الثلاث، بما يتماشى وطبيعة النظام السياسي شبه الرئاسي، مؤكداً أن وثيقة التعديلات الدستورية مستوحاة من صميم مطالب الحراك الشعبي.
استفتاء تعديل الدستور ليس أولوية
ويستبعد الحقوقي سليمان شرقي، في تصريح لـ”اندبندنت عربية”، أن ما تطرحه السلطة هو نظام شبه رئاسي، بسبب أن معظم الصلاحيات مركزة في يد الرئيس بما فيها تعيين رئيس الحكومة، كما أن الرئيس لا يُسأل عما يفعل وليس هناك جهة تراقبه، وأبرز أن النظام لن يغامر بفتح العملية الانتخابية لا سيما في الرئاسيات، فلا يسمح بالوصول إلا من رفوف درجه وليس عبر الصندوق الشفاف، وحتى رئيس الحكومة لم تُمنح له كامل الصلاحيات، مضيفاً أن النظام وإن كان من عادته فتح هامش حرية خلال الانتخابات التشريعية لإبداء بعض مظاهر التعددية، إلا أنه أغلق باب المفاجأة بشأن احتمال ظهور كتلة غير مرغوب فيها تشكل غالبية، بأن ترك أمر تعيين رئيس الحكومة في يد الرئيس، والذي لا يلزمه التعديل المقترح اختياره من الغالبية. وتابع أن “تمسك الأحزاب خصوصاً الإسلامية منها بالنظام البرلماني، فلأنها تعتقد تجذرها وانتشارها شعبياً، وأن لها قواعد منتشرة ومهيكلة تتيح لها اكتساح أي انتخابات تشريعية لو وفرت لها حداً أدنى من ضمانات نزاهتها”.
ودفع الصراع على طبيعة نظام الحكم وبعض التعديلات إلى “همس” السلطة بأن موضوع إجراء استفتاء تعديل الدستور أصبح من غير الأولويات في هذه المرحلة. وقالت السلطة المستقلة للانتخابات، إن جائحة كورونا التي مست العالم، كانت سبباً في مراجعة الأجندة السياسية لرئيس الجمهورية، وتركيز الأولويات في الحفاظ على صحة المواطنين وسلامتهم. تصريحات تكشف عن حجم التناقض بين ما اقترحه الرئيس تبون والأحزاب السياسية، خصوصاً المعارضة، التي قدمت مقترحات كثيرة مست نقاطاً عدة، وكان طبيعة نظام الحكم إحدى أهم النقاط إثارة للجدل.
