لا تزال العديد من تفاصيل القضية غير واضحة أو مكتملة
إدعى مفوض الحكومة المعاون لدى المحكمة العسكرية في لبنان، القاضي فادي عقيقي على الناشطة الموقوفة كيندا الخطيب، في “جرم التعامل مع العدو ودخول الأراضي الفلسطينية المحتلة والتعامل مع جواسيس العدو الإسرائيلي والمتعاملين لمصلحته”، وأحالها مع الملف إلى قاضي التحقيق العسكري الأول بالإنابة القاضي فادي صوان، طالباً استجوابها وإصدار مذكرة توقيف وجاهية في حقها.
في المقابل، نفّذ ناشطون وأقارب كيندا ورفاقها، اعتصاماً أمام مقر المحكمة العسكرية في بيروت، تضامناً مع الناشطة وغيرها من الناشطين الذين تعرضوا للتوقيف. وطالبوا بإطلاق سراحها واعتبارها موقوفة سياسياً بسبب تغريداتها المناهضة للسلطة، وسط إجراءات أمنية مشددة فرضتها الشرطة العسكرية وفرقة مكافحة الشغب في قوى الأمن الداخلي عند مداخل المحكمة العسكرية وفي محيطها.
ورفض بندر، شقيق كيندا، تهمة العمالة لشقيقته، مشدداً على أن “عكار ليست أرضاً للعمالة بل هي منبع ورافد للجيش اللبناني”.

ما هي المواد؟
والمواد التي تم الإدعاء بها على كيندا، هي المواد 285 عقوبات و 278 عقوبات، إضافة إلى المادة الأولى معطوفة على المادة 5 من قانون مقاطعة إسرائيل.
وتنص المادة 1 من قانون مقاطعة إسرائيل على أنه “يحظر على كل شخص طبيعي أو معنوي أن يعقد بالذات أو بالواسطة اتفاقاً مع هيئات أو أشخاص مقيمين في إسرائيل أو منتمين إليها بجنسيتهم أو يعملون لحسابها أو لمصلحتها وذلك متى كان موضوع الاتفاق صفقة تجارية أو عمليات مالية أو أي تعامل آخر أياً كانت طبيعته”.
فيما تنص المادة 285 – (عدلت بموجب 239 /1993) على أنه “يُعاقب بالحبس سنة على الأقل وبغرامة لا تقل عن مئتي ألف ليرة (133 دولاراً) كل لبناني وكل شخص ساكن لبنان أقدم أو حاول أن يقدم مباشرة أو بواسطة شخص مستعار على صفقة تجارية أو أي صفقة شراء أو بيع أو مقايضة مع أحد رعايا العدو أو مع شخص ساكن بلاد العدو”.
أما المادة 278 – (عدلت بموجب 6 /1975) تنص على أن “كل لبناني قدم مسكناً أو طعاماً أو لباساً لجاسوس أو جندي من جنود الأعداء يعمل للاستكشاف أو لعميل من عملاء الأعداء أو ساعده على الهرب أو أجرى اتصالاً مع أحد هؤلاء الجواسيس أو الجنود أو العملاء وهو على بينة من أمره يعاقب بالأشغال الشاقة المؤقتة”.
إشارة إلى أن قانون العقوبات اللبناني يجرّم المتعامل مع إسرائيل بالحبس 15 سنة.
وفيما لا تزال العديد من تفاصيل القضية غير واضحة أو مكتملة، خصوصاً أن الاتهامات التي وُجّهت لكيندا بالعمالة بدأت عبر مواقع التواصل الاجتماعي استناداً إلى تسريبات أمنية، قالت محامية الدفاع عنها جوسلين الراعي، في تصريحات من أمام المحكمة العسكرية اليوم، إنّها لن تكشف تفاصيل التحقيق التي يجب أن تبقى سرية وبعيدة من التداول الإعلامي، مشددة على ثقتها بالقضاء اللبناني الذي سيقول كلمته في هذه القضية.
ونفى بندر الخطيب، شقيق كيندا، من أمام المحكمة العسكرية دخوله وشقيقته الأراضي الفلسطينية المحتلة، مؤكداً أنه وشقيقته لم يتركا العاصمة الأردنيّة عمّان خلال زيارتها. واعتبر أن شقيقته تدفع اليوم ضريبة مهاجمتها الأحزاب التي تحمل السلاح.
