عرب وعالمعربي أسباب داخلية وخارجية تدفع السعودية لرفع الوصاية عن للمرأة by admin 3 أغسطس، 2019 written by admin 3 أغسطس، 2019 67 DW إسماعيل عزام / يستمر الأمير محمد بن سلمان في خططه بمنح مكتسبات جديدة للمرأة السعودية، بشكل يقطع مع النظرة التقليدية لبلد عانى من تفسيرات متشددة للإسلام. لكن هناك أسباباً داخلية وخارجية أدت إلى هذه الإصلاحات، فما هي هذه الأسباب؟ في خطوة منتظرة تسرّبت بعض تفاصيلها قبل أيام، أعلنت السعودية عن تعديلات جديدة ترفع بعض القيود عن سفر المرأة، وذلك بالسماح للنساء فوق 21 عاماً، بالسفر خارج البلاد واستصدار جواز السفر دون الحاجة إلى ولي الأمر، وذلك “امتداداً لسلسلة من الإصلاحات والمبادرات الساعية إلى تعديل وتطوير الأنظمة والقوانين الحكومية بما يتوافق واحتياجات المجتمع” وفق منشور لمركز التواصل الحكومي في السعودية. وجاء في المنشور، أن هذه الأنظمة الجديدة تمثل “فرصة أمام النساء لتولي المناصب العليا في الحكومة، بما فيها منصب نائب ومساعد الوزير أو سفير”، ما يجعل القوانين السعودية متماشية مع الإجراء الذي أعلن عنه الملك سلمان عن عبد العزيز، عندما عيّن الأميرة ريما بنت بندر بن سلطان آل سعود في منصب سفيرة المملكة بواشنطن، في أول مرة تصل فيها سيدة سعودية إلى هذا المنصب، وهي فاتحة يُنتظر منها وصول نساء أخريات إلى مناصب عليا في دولة كانت مهام المسؤولية فيها مقتصرة على الرجال. ويدرك المتتبع للوضع السعودي، أن هناك تغييرات كبرى تطرأ على نظرة الدولة إلى المرأة منذ وصول ولي العهد محمد بن سلمان إلى الحكم، فعلاوة على السماح للنساء بقيادة السيارة، وبالتالي إسقاط أحد أغرب القوانين في العالم، أضحى بإمكانهن الترّشح في الانتخابات، وجرى تمكين خريجات الثانوية العامة من الترشح للوظائف العسكرية، فضلاً عن فتح المجال أمام النساء لدخول الملاعب الرياضية، وإلغاء الوصاية على حصول المرأة على بعض الوثائق الإدارية، ومكتسبات أخرى في مجاليْ الحضانة والترفيه. انتهى فصل من التاريخ المحلي، وخرجنا من عنق الزحاجة.التعديلات الحديثة على الأنظمة الثلاثة قفزة نوعية هائلة في الملف الحقوقي في السعودية.ولن تكون المرأة بعد اليوم (أجندة) رابحة للمزايدة الدينية والاجتماعية أو للاستعراض السياسي .. لا إخوان ولا سرورية ولا منظمات أجنبية — لطيفة الشعلان (@LatifahAshaalan) August 2, 2019 وترى الإعلامية السعودية وعضو المجلس البلدي بالقطيف، عرفات الماجد، أن القرار “يبقى متأخرا، وأن الكثير من السيدات تضرّرن من هذا التأخر، خاصةً الأرامل والمطلقات منهن، إذ كانت تبعات النظام الذكوري الذي يعطي الرجل كامل السلطة في استخراج الوثائق الأسرية كبيرة جداً على مدار 40 سنة”، وذلك في إشارة منها إلى أن قوانين الوصاية لم تكن في المملكة قبل هذا التاريخ. أسباب داخلية تشير تقارير صحفية متعددة إلى تأثر كبير من الأمير محمد بن سلمان بولي العهد الإماراتي محمد بن زايد، خاصة فيما يتعلّق بالانفتاح الاجتماعي الكبير في الإمارات، فإن كانت شراكة الرجلين وثيقة في ملفات سياسية كمقاطعة قطر وحرب اليمن، فإن تأثير رجل الإمارات في مجالات أخرى يبقى واضحا، خاصة أن وسائل إعلام تحدثت عن أن محمد بن زايد روّج لوصول محمد بن سلمان إلى السلطة قبل أن يتم تعيين الأمير السعودي في منصب ولي العهد. تغيّر شكل السعودية مع بزوغ نجم محمد بن سلمان وتوجد أسباب أخرى تخصّ شخصية محمد بن سلمان، فهو أول ولي عهد ينتمي إلى جيل أحفاد الملك عبد العزيز وليس أبنائه، ما يجعل لفرق السن بينه وبين ملوك السعودية وولاة العهد السابقين أهمية كبرى في النظر إلى الأمور، خاصة ما يتعلق بالعقلية المحافظة للدولة. ويجد انفتاح الأمير محمد في المجال الاجتماعي صدىً في سياساته الاقتصادية، فهو داعم كبير لانتقال المملكة من الاعتماد شبه التام على النفط إلى دولة ذات اقتصاد متنوع، وهو ما تلخصه رؤية 2030، لكن مع ضرورة الإشارة أن هذا الخيار الاقتصادي كان ضرورياً بسبب الهزات السلبية التي تشهدها سوق النفط، والتأكيدات بكون النفط يبقى معرضاً للنضوب ولا يعد مورداً دائماً يمكن الاعتماد عليه. ولا يمكن إغفال الحركية المجتمعية النشطة في السعودية، خاصة الحركة النسائية، إذ شاركت سيدات سعوديات في حملات واسعة للمطالبة بحقوق أكثر. وفضلا عن ذلك، ظهرت أجيال جديدة من الشباب السعودي الراغب في القطع مع التيار التقليداني داخل المملكة، خاصةً أن حرمان المرأة السعودية من كثير من حقوقها مرتبط بتفسيرات دينية متشددة جرى الرد عليها من قبل فقهاء وعلماء دين آخرين. وتقول عرفات الماجد لـ DW عربية، “لا يمكن تجاهل الدور الكبير الذي قامت به ناشطات نسائيات سعوديات في سنّ هذه القوانين، خاصة أنهن قدمن مشاريع لها منذ مدة”، لافتة إلى أن الاعتقال الذي طال بعض ناشطات “رفع الوصاية”، يعود إلى تجاوزهن، وفق وجهة نظر الدولة، القوانين والأنظمة، علماً أن بعضهن جرى الإفراج عنهن، في وقت ضغطت فيه ناشطات أخريات ضمن إطار الأنظمة المعمول بها. أسباب خارجية غير أنه لا يمكن إهمال الأسباب الخارجية في هذا التحوّل، فالمنظمات الحقوقية تضغط على السعودية منذ فترة طويلة، وتقاريرها دائما ما ركزت على حقوق المرأة. وتهتم الرياض في هذا السياق بصورتها في العالم، خاصةً أن الحقوق التي جرى الإعلان عنها، لا تحمل تأثيرا سياسيا ولا توّسع هامش الحريات السياسية في المملكة، بل على العكس، تُمكّن السعودية من تخفيف الاحتقان المجتمعي الذي ظهرا مؤخرا على خلفية سن الضرائب والزيادات في الأسعار. سنّ الثلاثين هو سنٌ مميز، ففيه نبلغ الاستقرار ونبدأ بتحقيق أحلامنا. اليوم، تحتفل الناشطة #السعودية #لجين_الهذلول بعيد ميلادها الثلاثين في الزنزانة عقابًا على نشاطها السلمي من أجل حقوق الإنسان. فلنتمنّى لها القوة والصمود ولنطالب KingSalman@ بالإفراج عنها فورًا دون شرط! pic.twitter.com/jh0TMDUViL — منظمة العفو الدولية (@AmnestyAR) July 31, 2019 لكن في المقابل، يبقى من الضروري إعطاء هذه الضغوط الدولية حجمها الطبيعي، ما دامت الرياض تتجاهل دعوات حقوقية مستمرة للإفراج عن ناشطات نسائيات، تواجه بعضهن اتهامات خطيرة رغم نشاطهن في قضايا حقوقية متعلّقة بحقوق المرأة مثل لجين الهذلول. كما تستمر الرياض في حرب اليمن رغم حث الأمم المتحدة أطراف الحرب على وقف هذه الحرب، وتستمر كذلك في اعتقال نشطاء وحقوقيين وحتى رجال دين مثل سلمان العودة. وفي هذا السياق، تستمر منظمة العفو الدولية في دعواتها بإطلاق سراح الناشطات النسائيات، لافتة إلى أنه رغم الإفراج المؤقت عن ناشطات كرقية المحارب وإيمان النفجان وعزيزة اليوسف، إلّا أن محاكمتهن لا تزال مستمرة، وتقول المنظمة في بيان لها إن “الإصلاحات الاجتماعية لا يمكن لها التستر على انتهاكات حقوق الإنسان والقمع الوحشي لنشطاء حقوق الإنسان”. العقلية المحافظة تواجه الإصلاحات غير أن أكبر التحديات التي تواجهها المملكة في قضايا حقوق المرأة لا تأتي من الخارج، بل من الداخل، إذ تقول عرفات الماجد: “سمو ولي العهد قام بخطوة جبارة، في ظل مجتمع محافظ”، لافتة إلى أن الكثير من السعوديين، وبينهم حتى مسؤولين، يرفضون هذه الإصلاحات لأنهم “لا يفهمونها، ولأن النقاش تمت أدلجته لكي لا يتم استعياب أهمية هذه الحقوق”. ويجد قول الماجد صدى له في تويتر، حيث عبّر مغردون سعوديون عن رفضهم التام للقرارات الأخيرة، مستشهدين بآراء لفقهاء سعوديين. إذ لا تزال النظرة المتشددة للدين وللمرأة منتشرة في السعودية. #لا_ولايه_علي_سفر_المراه سفر المرأة بدون محْرم ..!
