الفقه الشيعي هناك حالياً مراجع مختلفة بينها خلافات غير قليلة حول مفهوم “ولاية الفقيه” وأمور كثيرة أخرى. ولكن معظم المراجع الذين نسمع بأسمائهم ينتمون إلى مدرسة كبيرة واحدة: المدرسة الأصولية. لم يكن الحال كذلك دائماً. فحتى القرن الثامن عشر، تصادمت مدرستان فقهيتان شيعيتان كبيرتان: الأصولية والأخبارية، إلى أن بدأت الأولى تسود إلى حد غاب ذكر المدرسة الثانية تقريباً في وقتنا الحالي. ومن المفارقات أن مما ساهم في ذلك وباءٌ حلّ على مدن العتبات المقدسة في العراق، في أواخر القرن الثامن عشر. صراع الأخبارية والأصولية ظهر الفريق الأخباري منذ ظهور الفقه الشيعي تقريباً، وينتمي إليه بعض أبرز الفقهاء الشيعة عبر التاريخ، وثارت خلافات منهجية بين أتباعه وبين الأصوليين حول مسائل كثيرة لها علاقة بكيفية استنباط الأحكام الشرعية. وإذا أردنا تلخيص هذه الخلافات، يمكن الحديث عن بضعة نقاط بارزة مثل تقليد غير المعصوم، فعموم الشيعة اليوم يُعرَفون بتقليد مرجع فقهي يطرح نفسه كشخصية أعلم منهم في شؤون الدين (ثنائية المجتهد والمقلِّد)، بينما كان الأخباريون يرفضون تقليد غير المعصوم، أي كل شخص من خارج دائرة أئمة الشيعة الـ12 والنبي. ولفهم هذه النقطة، يمكن العودة إلى كتابات كثيرة منها ما كتبه الفيض الكاشاني (ت. 1091هـ/ 1680م) عن أن عقول غير المعصومين ناقصة، ما يعني أنه لا يمكن الاعتماد عليها لاستباط الأحكام الشرعية. من جهة ثانية، يعتبر الأخباريون أن الأحاديث المروية عن أئمة الشيعة المعصومين هي المصدر الوحيد لاستنباط الأحكام الشرعية، ويرفضون الاجتهاد، بعكس الأصوليين الذين يعملون به. تاريخياً، بدأت غلبة التيار الأصولي على التيار الأخباري منذ القرن الخامس الهجري مع ظهور الشيخ المفيد (ت. 413هـ/ 1022م) والسيد مرتضى الأنصاري (ت. 436هـ/ 1044م) وأبي جعفر محمد بن الحسن الطوسي المعروف بـ”شيخ الطائفة” (ت. 460هـ/ 1068م)، فقد تفوّق انتشار أفكارهم على انتشار أفكار المجتهدين الأخباريين. ولكن في القرن السابع عشر، حدث تحوّل كبير في التوازنات بين التيارين، مع ظهور الميرزا محمد أمين الأسترابادي. ومعه، “تبلورت (الأخبارية) في حركات منفصلة تعلي من أهمية الفروق ‘الكلامية’ – المنهجية إلى مستوى العزل من الملّة”، حسبما نقل فالح عبد الجبار في كتابه “العمامة والأفندي/ سوسيولوجيا خطاب وحركات الاحتجاج الديني” عن الباحثين موجان مومن وأحمد كاظمي موسوي. ويروي عبد الجبار، نقلاً عن الباحث جوان كول، أن العداء بين الطرفين بلغ نقطة لم يعد الأخباريون عندها ليسمحوا لأنفسهم بلمس أي كتاب أصولي بدون استخدام منديل درءاً للنجاسة، ويضيف: “انطوى التصادم على صراع حاد على النفوذ مقروناً بانقسام فكري/ اجتماعي عميق امتد ليتجاوز القضايا الفقهية”. في المقلب الآخر، حرّم قائد التيار الأصولي المعروف باسم “آية الله الوحيد البهبهاني”، واسمه الشيخ محمد باقر بن محمد أكمل الأصفهاني (ت. 1205هـ/ 1791م)، والذي قدم من إيران واستقر في كربلاء، الصلاة خلف زعيم الأخباريين، الشيخ يوسف البحراني، حسبما ذكر محمد باقر الخوانساري في كتابه “روضات الجنات”، مع أن البحراني كان من الأخباريين المعتدلين. الشيعة والسنة: هل من مبرر لكل هذا الكره؟ الربيع العربي ونظريّات نهاية الزمان عند الشيعة كيف انتشر المذهب الشيعي في إيران؟ حركة الميرزا الأسترابادي يكتب فالح عبد الجبار في كتابه المذكور (سنسقط ذكر مراجعه تسهيلاً على القارئ)*: من الحجاز، في شبه الجزيرة العربية، بدأ الأسترابادي هجومه على الأصولية المتحالفة مع الصفويين. ولأنه كان يقيم في مكة فقد كان باستطاعته أن يتصرف بحرية، تدعمه في ذلك شخصيات شيعية بارزة في جبل عامل من أمثال الحر العاملي، وفي بلاد فارس مثل شيخ الإسلام في مشهد. وسرعان ما ازدهرت الحركة في البحرين وفي العراق العثماني، وفي جيوب داخل بلاد فارس. وفي مؤلفه “الفوائد المدنية” رفض الأسترابادي مفهوم “الاجتهاد” و”العقل” و”الظن” (المعرفة المحتملة)، وشدد على أهمية “الأخبار” (أي السنن والتقاليد) التي قام بنقلها (الأئمة) المعصومون، وحصر مصادر العقيدة والشرع في اثنين، هما القرآن والسنّة، ولا مكان لـ”العقل” أو “الإجماع”. وبالنسبة إليه، فإن العقل والإجماع من التقاليد السنّية وانحرافات سنّية. أما “المجتهدون” فهم، من وجهة النظر الأخبارية، مثل أتباعهم من عامة الناس، “مقلدون” للأئمة، وليس لأي كائن بشري الحق في أن يقلَّد. واتسعت قائمة الاختلافات بين المدرستين لتبلغ تسعاً وعشرين نقطة، بل إن بعض المصادر أوصلتها إلى ثلاث وأربعين، بل ست وثمانين. لقد كانت العقيدة الأخبارية تستهدف زعزعة أسس السلطة الدينية للأصوليين القائمة على المعرفة الفقهية. كما ألغت الأخبارية ثنائية العلماء – العامة حق “المجتهدين” في أن ينوبوا عن الإمام… كما أن (الأخباريين) أفلحوا في اجتذاب جمهرة المؤمنين العاديين من خلال “القوى الورعة”، الأمر الذي أدى إلى محاولة تحقيق التوافق ما بين التقاليد الشعبية المتأثرة بالتصوف مع الفقه الشرعي الجاف. كان العالم الشيعي في القرن الـ17 منقسماً إلى ثلاث دوائر: دائرة أصولية صفوية في بلاد فارس، ومدرسة أصولية عربية مستقلة في جبل عامل، ودائرة أخبارية في العراق العثماني والبحرين والحجاز… ولكن وباءً ضرب مدن العتبات المقدسة في العراق غيّر المعادلة وفي موازاة خط التطور هذا، بل حتى قبله، كان التوجه الأخباري يلقى مساندة له في العراق العثماني وفي البحرين والحجاز منذ زمن (الشيخ إبراهيم بن سليمان) القطيفي الذي عارض تحالف (الفقيه علي) الكركي مع الشاهيْن الصفويين إسماعيل وطهماسب، وأقام انتقاده ومعارضته على أسس أخبارية، أي رفض تأدية صلاة الجمعة وجمع الضرائب أو جباية الخراج ونيابة الفقيه عن الإمام والواجبات الأخرى التي يمكن أن يؤديها الفقهاء الشيعة في ظل الحاكم الجائر. العالم الشيعي بين الأخبارية والأصولية كان العالم الشيعي في القرن السابع عشر منقسماً إلى ثلاث دوائر: دائرة أصولية صفوية في بلاد فارس، ومدرسة أصولية عربية مستقلة في جبل عامل، ودائرة أخبارية في العراق العثماني والبحرين والحجاز. ولقد أدى السقوط المفاجئ للدائرة الأولى على يد القبائل الأفغانية السنّية الغازية (في العام 1722) إلى تحطيم القاعدة الراسخة للمدرسة (الأصولية) التي كانت ترعاها الدولة في بلاد فارس. فقد تمت مصادرة الأوقاف الداعمة لطبقة رجال الدين، كما تم تدمير شبكات الرعاية، وتهجير المئات من عوائل الفقهاء. وأدت هذه الحالة إلى “حصول إفقار نسبي واضمحلال في نفوذ هذه المجموعة من طبقة العلماء، فكان أن هربت أعداد كبيرة من رجال الدين والتجار من إيران باتجاه مدن العتبات المقدسة في العراق العثماني”. فوصل العلماء المهاجرون إلى هذه المدن بصفة لاجئين مدقعين، محرومين من الصلات والشبكات الاجتماعية، فتحولوا إلى المدرسة الأخبارية. أما المجموعة الأخرى التي بقيت في بلاد فارس فقد خضعت إلى تحوّل اجتماعي. فلم تعد أسباب عيشهم متاحة في البلاط الملكي، أو لم تعد مقتصرة على البلاط. وبدأت هذه الشريحة تسعى وراء تعزيز علاقاتها مع “طبقة البازار الأغنى، سعياً وراء الحصول على أنماط جديدة من الأمن الاقتصادي”. بل إن بعض أفراد أسر “العلماء” ارتبطوا عن طريق المصاهرة بتجار وحرفيي البازار بما لدى هؤلاء من شبكات اجتماعية ونقابات (أصناف) حرفية مستقلة وقوية. كما شرعوا بالقيام بوظائف جديدة لا علاقة لها بالدين مثل الصيرفة وصك النقود، وملكية الأراضي، وإدارة الأملاك. بيد أن بعضهم بقي محتفظاً بوظائفه الدينية. ومن المفارقة أن هذا التحول أدى بـ”العلماء” إلى خلق قاعدة مالية مستقلة حررتهم من رعاية الدولة وعززت قوتهم ونفوذهم في فترات زمنية لاحقة. عودة “الأصولية الجديدة” في وقت لاحق من القرن بدأت عناصر أصولية مهاجرة في مدن العتبات في النجف وكربلاء والكاظمية تعود إلى بلاد فارس، وذلك أولاً خلال الحقبة الزندية (1763 – 1779) وفي وقت لاحق خلال الحقبة القاجارية. وقد اقترن إحياء حركتهم هذه باسم محمد باقر أكمل البهبهاني (1704 – 1791). ففي كربلاء بدأ البهبهاني حملته المعادية للأخبارية في منتهى الحرص والسرية. ذلك أن الأصولية لم تكن قد طُردت من الملّة حسب، بل إن “العلماء” الأخباريين كانوا يمتلكون وسائل القسر المادي للتعامل مع أي انشقاق، وتمثلت تلك الوسائل برمز اللوتيين. كانت الخلايا السرية الأولى التي نظمها البهبهاني مقصورة على أقاربه، وكانت علاقاته مع شبكات التجار والحرفيين تؤمّن ما كان يحتاج إليه من موارد. فكان أن اكتسبت الحركة مساندين لها وصادفت ظروفاً مواتية. فقد اجتاح الطاعون مدن العتبات المقدسة في العراق (في الربع الأخير من القرن الثامن عشر)، ما أدى إلى هلاك عدد كبير جداً من الناس بمن فيهم “علماء” (أخباريون) عرب ما كان بمقدورهم أن يهربوا إلى إيران مثلما فعل رفاقهم الفرس. وسرعان ما امتلأ الفراغ الذي أعقب ذلك بالأصوليين الصاعدين. ولقد عززت تطورات سياسية موقع هذه المجموعة، إذ أمسى حكم المماليك في العراق العثماني أشد ضعفاً ولم يعد في استطاعته أن يسيطر على دولة – المدينة الشيعية الناشئة في النجف وكربلاء اللتين كانتا تسعيان إلى ترسيخ استقلالهما. ولقد تشكل العمود الفقري لهذا الاستقلال الذاتي من تحالف اجتماعي قوي يضم ملّاكاً للأرض وتجاراً عرباً، وحرفيين (معظمهم إيرانيون) وزمراً مسلحة من العرب والفرس. وكان مما عزز هذا التوجه بصورة أقوى تشكّل الدولتين الشيعيتين في إيران القاجارية وإمارة أوده (في الهند). وكانت المدرسة (الأصولية) بمثابة القوة المشرعنة لهاتين السلالتين الحاكمتين البارزتين حديثاً. اجتاح الطاعون مدن العتبات المقدسة في العراق في القرن الـ18، ما أدى إلى هلاك عدد كبير جداً من الناس بمن فيهم “علماء” أخباريون عرب ما كان بمقدورهم أن يهربوا إلى إيران مثلما فعل رفاقهم الفرس. وسرعان ما امتلأ الفراغ الذي أعقب ذلك بالأصوليين الصاعدين لقد نمت (الأصولية الجديدة) في القرنين الثامن عشر والتاسع عشر في ظل ظروف غير مسبوقة. فلقد كانت يومذاك في تحالف راسخ داخل إيران مع طبقات غنية منتجة – تجار البازار والحرفيين وكبار ملّاك الأرض – ذات مصادر دخل مستقلة عن رعاية الدولة ومنتظمة في شبكات اجتماعية واسعة. وكانت المراكز القيادية لطبقة رجال الدين ومعها (مدارسها) موجودة في مدن العتبات في العراق العثماني. غير أن الدولتين الشيعيتين الجديدتين، القاجارية والأودية (الهندية)، كانتا إما على درجة كبيرة من الضعف أو من البعد الجغرافي بحيث لم يكن لهما نفوذ مباشر على مراكز “الاجتهاد”. ثم إن “العلماء” كانت لديهم لأول مرة أداة للقسر متمثلة في اللوتيين، وهم زمر من العصابات الحضرية المسلحة في مدن العتبات كانوا يقايضون خدماتهم الأمنية بالنقود مع طبقة التجار ورجال الدين معاً، وذلك من خلال توظيفهم وتنظيمهم لوسائل العنف. وفي هذه الفترة الزمنية نمت ميول نحو المركزة، الأمر الذي أدى إلى ظهور “مرجع التقليد المطلق” بصفته المصدر الأعلى للسلطة الدينية**. وأعادت (الأصولية الجديدة) التأكيد على مقولات المعرفة (“العلم”) وقدرة “العقل” ووجوب “الاجتهاد”، والمعرفة الظنية، علاوة على مقولات السلطة المرجعية، مثل: ضرورة تقليد عالم على قيد الحياة بدل عالم ميت، ودفع الزكاة والخمس إلى “المجتهدين” بصفتهم نواباً عن الإمام. وبهذا يكون هذا التوجه التجديدي بمثابة إعادة تعريف للبنية الداخلية للعالم الشيعي وإرساء حجر الزاوية لظهور “مرجع التقليد” ومركزته. *كل ما يرد أدنى هذه الإشارة، باستثناء العناوين الفرعية، منقول عن كتاب عبد الجبار
