جنوبية – بيروت / أقرّ البرلمان اللبناني مشروع قانون يسمح بزراعة القنب الهندي (الحشيش) للاستعمال الطبي والصناعي. لنتعرف على القانون
في ظل أزمة اقتصادية غير مسبوقة، أقرّ مجلس النواب مشروع قانون يسمح بزراعة القنب الهندي (الحشيش) للاستعمال الطبي والصناعي، لتوفير مورد إضافي للخزينة الدولة.
وفيما يعد لبنان هو رابع منتج للحشيش عالميًا رغم أن القانون اللبناني يعاقب على زراعته بالسجن والغرامة المالية، يعوّل على خطوة تشريع زراعة القنب لأغراض طبية وصناعية، ان تفتح أبواباً اقتصادية “قانونية” قد تخلق ديناميّة معيشيّة عامة في لبنان، تُخرج تجارة الحشيشة من قيود “مافياوية” كانت تتحكم بها، وتتيحها أمام مئات المزارعين في ظلّ الأوضاع المعيشية الصعبة
كل ما يجب أن تعرفه عن تراخيص زارعة القنب: شروطها وإلغاؤها وتجديدها!
وفيما يتعلق بمنح التراخيص لزارعة نبتة القنب للاستخدام الطبي والصناعي، بحسب ما جاء في القانون، يتحدث البند الثالث عن منح التراخيص ومراقبتها وإلغاؤها وتجديدها، وهي على الشكل التالي:
المادة 14: منح التراخيص لزارعة نبتة القنب
يعود للهيئة الناظمة لزارعة نبتة القنب الحق الحصري بمنح التراخيص اللازمة لزراعة النبتة والعمليات المتفرعة عنها بعد التأكد من الامتثال لأحكام هذا القانون وشروطه.
المادة 17: أنواع التراخيص لزارعة نبتة القنب
يمكن للهيئة أن تمنح التراخيص الآتية:
- ترخيص استيراد بذور وشتول القنب “الحشيشة”.
- ترخيص إنشاء مشاتل القنب.
- ترخيص الزرع والحصاد.
- ترخيص التصنيع.
- ترخيص إنشاء مراكز الأبحاث والمختبرات.
- ترخيص التصدير.
- ترخيص النقل والتخزين.
- ترخيص البيع والتوزيع.
المادة 18: الشروط المؤهلة لطلب الترخيص لزارعة نبتة القنب
يمكن أن يطلب الترخيص:
- شركات لبنانية مجازة لصناعة الأدوية من قبل وزارة الصحة والعامة، على أن تحصل قبل المباشرة بأي عملية منصوص عنها في هذا القانون، على ترخيص في شأن العمليات التي ستقوم بها، بعد تقديم المستندات المحددة من الهيئة، وعلى أن تستحصل على شهادات الأصول الجيدة لزراعة نبتة القنب (GACP) وتخزينها (GSP) وصناعة المواد الأولية أو المستحضرات الصيدلانية والمعدة من القنب (GMP) وفق العمليات المحددة في الترخيص.
- شركات صناعية لبنانية مجازة من وزارة الصناعة لصناعة الألياف للاستعمال الصناعي والزيوت والمستخلصات، على أن تحصل، قبل المباشرة بأي عملية منصوص عنها في هذا القانون، على ترخيص في شأن العمليات التي ستقوم بها، بعد تقديم المستندات المحددة من الهيئة، وعلى أن تستحصل على شهادات الأصول الجيدة لزراعة نبتة القنب (GACP) وتخزينها (GSP).
- شركات أجنبية متخصصة بهذا المجال زراعة أو صناعة أو تخزيناً أو تصديراً أو تسويقاً، تكون حائزة على ترخيص من الدولة التي تنتمي إليها للقيام بإحدى العمليات المحددة في الترخيص وتستثمر في لبنان عبر التصنيع محلياً وفاقاً للآلية المحددة في القوانين المرعية الإجراء ذات الصلة.
- التعاونيات الزراعة المنشأة أصولاً في لبنان والتي تتمتع بأهلية التجاوب والتكيّف من شروط الترخيص لجهة الوجهة الزراعية تحديداً.
- الشخص الطبيعي اللبناني، على مثال المزارع أو المالك، أو المستأجر… الذي تتوافر فيه الشروط الآتية متضافرة للحصول على ترخيص ضمن الوجهة الزراعية تحديداً:
- أن يكون بلغ الواحدة والعشرين من العمر.
- أن يكون مقيماً في لبنان.
- أن يكون قادراً على التجاوب التكيّف مع شروط الترخيص والالتزامات المتفرعة عنه.
- أن لا يكون محكوماً بجنحة أو جناية شائنة عملاً بأحكام قانون العقوبات اللبناني، أو بجرم مخدرات بمفهوم القانون 673/98 أو بجرم تبييض أموال عملاً بالقانون اللبناني ذي الصلة.
مراكز الأبحاث والمختبرات والمعاهد العلمية المعترف بها، على أن تتمتع بالمؤهلات المهنية والعلمية التي تستدعي اختصاصها استعمال المواد الموضوعة قيد المراقبة.
المادة 19: مضمون طلب الترخيص لزارعة نبتة القنب
على من يرغب بالحصول على ترخيص لزراعة القنب وسائر العمليات المتفرعة عنها أن يتقدم بطلب خطي، وفق النموذج المعتمد في السجل موقع أصولاً، مع إيراد المعلومات الآتية:
- هوية الجهة طالبة الترخيص وجنسيتها.
- مدة الترخيص ونوعه.
- العمليات المطلوب الترخيص بها.
- أماكن التخزين والتعبئة والتغليف وإجراءات السلامة والأمن التي ستطبق فيها.
- معايير وطرق التخزين والتعبئة والتغليف المعتمدة. على أن يرفق الطلب بالمستندات الآتية تحت طائلة رفض الطلب عند التخلف غير المبرر:
- نسخة عن بطاقة الهوية والسجل العدلي للشخص الطبيعي وإذاعة تجارية حديثة للشخص المعنوي.
- إفادة عقارية تثبت ملكية الجهة طالبة الترخيص للعقار أو ما يثبت حقها في زراعته بنبتة القنب بموافقة الجهة المالكة في حال لم يكن طالب الترخيص مالكاً مع تحديد صفة الجهة طالبة الترخيص عندها وسند المطالبة.
- تعهد شخصي من الشخص الطبيعي مصدق لدى الكاتب العدل يؤكد بموجبه صحة المعلومات الواردة في الطلب.
- كتاب من الشخص المعنوي بواسطة المدير المفوض بصحة المعلومات الواردة في الطلب مصدق عليه من الكاتب العدل.
وتحدد إجراءات دراسة الطلب وتقييمه والبت به، آلية ومهلاً، بموجب النظام الداخلي للهيئة.
المادة 20: قرار الترخيص لزارعة نبتة القنب
- للهيئة الحق في قبول طلب الترخيص أو رفضه على تبت به بقرار معلل في خلال مهلة ستين يوم عمل من تاريخ تقديمه وللهيئة أن تطلب في خلال هذه المهلة الإيضاحات اللازمة أو تستكمل المستندات الهادفة أو تتوسّع في التحقيق على أن تبلغ الجهة طالبة الترخيص أصولاً وتلتزم بمهلة الستين يوماً للبت. ويعتبر الطلب مقبولاً في حال عدم البت به في خلال هذه المهلة، قبولاً أو رفضاً، بالرغم من استكمال الملف حيثياته المبررة. ولمقدم الطلب المرفوض أن يراجع أمام الهيئة استرحاماً خلال أسبوع من تاريخ تبليغ القرار على أن يكون له في مطلق الأحوال أن يطعن بهذا القرار أمام مجلس شورى الدولة وفاقاً للأصول المرعية.
- يمنح الترخيص لمدى ثلاث سنوات قابلة للتجديد، باسم مالك العقار أو صاحب الحق بموجب قرار يصدر عن الهيئة موقع من رئيسها على أن يتضمن وجوباً:
- اسم الشخص الطبيعي أو المعنوي المرخص له والجنسية.
- الإطار الزمني والشروط التي يخضع لها الترخيص.
- الموقع الذي ستجري فيه عملية الزراعة والنمو والحصاد والتصنيع.
- أصل ومحتوى البذور أو النباتات التي ستستخدم في الزراعة.
- حجم الإنتاج المعتمد والعمليات المسموح بها.
- إجراءات السلامة والأمن التي سيتم تطبيقها.
- ضمانات الامتثال للالتزامات.
- مصير إنتاج الفائض وبقايا المحصول ورواسب العمليات والمنتجات الفاسدة وغير المطابقة.
- شروط التعبئة والتغليف ووضع العلامات للمنتج.
- البيانات المتعلقة بالمالك والشركاء والمستخدمين العاملين في المشروع وأرقام بطاقاتهم الشخصية ومهامهم.
ينشر قرار منح الترخيص في الجريدة الرسمية وجريدتين محليتين ويعمل به فور نشره.
المادة 21: حظر الترخيص
- يُحظر الترخيص لأي من الأشخاص المذكورين أدناه:
- أعضاء وموظفي الهيئة والمتعاقدين معها وأقاربهم حتى الدرجة الرابعة.
- مقدمي طلبات الترخيص غير المؤهلين تبعاً لصدور حكم قضائي نهائي بحقهم بصفتهم فاعلين أو شركاء أو متدخلين في الجنايات والجنح الشائنة المنصوص عنها في قانون العقوبات أو في جرائم تبييض الأموال تبعاً لأحكام قانون مكافحة تبييض الأموال.
- على أنه يحق لمن أعيدُ اعتباره بموجب قرار قضائي الحصول على ترخيص وفقاً لأحكام القانون.
المادة 22: انتهاء مدة الترخيص وتجديده
- ينتهي العمل بالترخيص بانتهاء مدته المحددة في قرار الترخيص أو بوفاة الشخص الطبيعي حيث يجوز للهيئة أن تأذن للورثة أو لمن يختارونه ممن تتوافر فيه المؤهلات المطلوب للاضطلاع بالالتزامات المفروضة بمقتضى القانون والترخيص، بمتابعة النشاط لفترة لا تتجاوز الستة أشهر أو لحين انتهاء الموسم. أو بإفلاس الشخص المعنوي وتصفيته.
- وينتهي العمل بالترخيص قبل انتهاء مدته في الحالات الآتية:
- بالتنازل عن الترخيص بعد موافقة الهيئة بقرار معلل يحدد شروط التنازل إلى جهة مرخصة بالنشاط ذاته إن كان من ناحية استيراد البذور أو تأصيلها محلياً أو استيلاد الشتول أو زرعها أو نقلها أو تخزينها أو تصنيعها أو تصديرها من المحصول الزراعي المعالج.
- بالعدول عن الترخيص بموافقة الهيئة التي تقرر سحب الرخصة في هذه الحال.
- بإلغاء الترخيص بسبب عدم صحة البيانات التي تضمنها طلب الترخيص أو بسبب فقدان أحد شروط الترخيص أو لعدم الالتزام بمضمون الترخيص.
- لصاحب الترخيص قبل انتهاء مدته بشهرين على الأقل، أن يتقدم بطلب تجديده وفق الأصول المنصوص عنها في المادة السادسة عشر من هذا القانون واستناداً إلى الترخيص الذي شارف على نهاية المدة، وعلى الهيئة أو تبت بالطلب في مهلة ثلاثين يوم عمل تبعاً للآلية الملحوظة في منح التراخيص.
المادة 23: إلغاء الترخيص لزارعة نبتة القنب
يُلغى حكماً أي ترخيص بعد منحه:
- إذا تبين أن الترخيص يُستعمل لمزروعات غير التي رُخص لها أساساً.
- إذا تبين أن الترخيص يستعمل لعمليات غير التي رُخص لها أساساً.
- إذا صدر حكم نهائي بحق أحد المساهمين الرئيسيين أو رئيس مجلس الإدارة أو أحد المديرين أو أحد المسؤولين التنفيذيين فيما خص الشخص المعنوي، أو الشخص الطبيعي في جناية أو جنحة شائنة أو في إحدى الجرائم المنصوص عنها في قانون المخدرات 673/98.
- إذا لم يستعمل خلال مدة سنة من تاريخ صدوره.
المادة 24: وقف العمل بالتراخيص
- يجوز وقف العمل بالترخيص بقرار من الهيئة:
عند ملاحقة المرخص له بجرم شائن أو بإحدى الجرائم المنصوص عنها في القانون 673/98 وصدور قرار ظني بحقه.
المادة 25: الرقابة على التراخيص
على الهيئة ممارسة الرقابة والتفتيش الدوري بواسطة أجهزتها، للتأكد من تقيّد أصحاب التراخيص بالشروط المفروضة لجهة المنشآت والعمليات المحددة في الترخيص لها كما والشروط الفنية والأمنية المطلوبة لمنع ارتكاب المخالفات على أنواعها.
المادة 26: مبدأ الشفافية والتعقُّب
تتابع الهيئة مراحل تطبيق القانون وتشرف على مراحله التنفيذية كافة التي تخضع لمبدأ الشفافية والتعقّب بدءاً من عملية أو عمليات استيراد البذور أو تأصيلها محلياً أو استيلاد الشتول أو زرعها أو حصادها أو تخزينها أو معالجة المحصول أو نقله أو تحويله إلى مواد أولية وبيعها محلياً وتصنيعها أو تصديرها وبيع المستحضرات الطبية أو الصيدلانية محلياً أو تصديرها، وتتمتع الهيئة بالصلاحيات الواسعة لضبط المخالفات ومراقبة الأعمال المجاز بها، ويكون لمفتشي الهيئة ومراقبيها صفة أفراد الضابطة العدلية ويرتبطون مباشرة بالنيابات العامة المختصة ويحق لهم تنظيم محاضر الضبط بالمخالفات المتعلقة بالتراخيص.
ويجوز للهيئة أن تستعين بالقوة العامة بأجهزتها كافة للمساعدة في تنفيذ مهام المراقبة وضبط وقمع المخالفات المتعلقة بالتراخيص.
