العودة، انتهت فعاليات ذلك اليوم من دون عودته، تواصلت مع جهات حقوقية وإنسانية عدة ولم أعرف مصيره”. بعد 40 يوماً من الاختفاء، أيقنت الوالدة بأنّ الاحتمال الأكبر أنّ ابنها قد يكون قتل، وإسرائيل تحتجز جثمانه. البداية اختفاء جثة محمود ليست الحالة الأولى، بل بدأت قصة احتجاز الجثامين منذ احتلال إسرائيل لفلسطين عام 1948، حينها كان الجيش يدفن الفدائيين في أماكن بعيدة من دون معرفة عائلاتهم أيّ معلومات عنهم. تؤكّد المعلومة منسقة الحملة الوطنية لاسترداد جثامين “الشهداء” المحتجزة لدى إسرائيل سلوى حماد، وتقول “لدينا 67 مفقوداً موثقاً يعود اختفائهم إلى عام 1948”. وتعمل إسرائيل على احتجاز العديد من جثامين الفلسطينيين منذ ذلك الحين، وتدفنهم في مقابر سريّة، لكن ملف الاحتجاز والدفن لم يكن ذي صدارة، حتى تأسست الحملة الوطنية لاسترداد جثامين “الشهداء” عام 2008، وبدأت تعمل على المستوى القانوني والحقوقي في استرداد الجثامين من إسرائيل، على رغم تهرب الأخيرة. بدأت الحملة الوطنية عملها في توثيق وحصر القتلى المحتجزين لدى إسرائيل، وبعدها توجّهت إلى المحكمة العليا الإسرائيلية، ورفعت دعوى قضائية طالبت فيها باسترداد الجثامين. تقول سلوى “بعد عامين تمكنا من انتزاع قرار من المحكمة بتسليم جثمان مشهور العاروري بعد 34 عاماً من الاحتجاز”. الإفراج الأول، بعث بريق أمل لعائلات فلسطينية لتحقيق إنجازٍ في الملف، وبالفعل، توالت الإنجازات. ففي عام 2013 حصلت الحملة الوطنية على قرار من المحكمة الإسرائيلية يقضي بتسليم 36 جثماناً، جلّهم من قتلى الانتفاضة الثانية (عام 2000). توضح سلوى أنّ إسرائيل سلمت 27، وتراجعت عن تسليم الباقي، بحجة أنّ العدوان على غزّة (صيف 2014) قد بدأ، وأنّ الأوضاع الأمنية غير مناسبة. المقابر كانت الجثامين التي أفرجت عنها إسرائيل مدفونة في مقابر الأرقام، وهذا المصطلح اعتمده الفلسطينيون نسبة إلى ظروف احتجاز الجثامين، وعادة ما يدفن الجيش الإسرائيلي جثث القتلى الفلسطينيين تحت الأرض في قبورٍ فوقها علامات معدنية تحمل أرقاماً فقط. وتوضح سلوى بأنّهم لا علم لهم حول دلالة الرقم الموجود على اللوحة ولمَن يعود. وحصلت “اندبندنت عربية” على معلومات دقيقة حول مقابر الأرقام، المدفون فيها جثامين قتلى من قطاع غزّة والضفة الغربية والقدس، وبعض العرب (سوريا ولبنان والعراق ومصر) وعددها أربعة، وهي تابعة للمؤسسة العسكرية الإسرائيلية، وأغلبها في المناطق الحدودية مع سوريا ولبنان، وواحدة موجودة في منطقة الأغوار قرب الأردن، وثمة معلومات غير مؤكّدة عن مقبرة في منطقة بئر السبع داخل إسرائيل. تشريع في أكتوبر (تشرين الأول) 2015، عادت إسرائيل لممارسة احتجاز جثامين القتلى، بقرار من الكابينت (مجلس وزاري مُصغر لشؤون محددة) كجزء من مجموعة إجراءات عقابية فرضت على المقدسيين وشملت كلّ الفلسطينيين. وعلى صعيد غزّة، احتجز الجيش الإسرائيلي حوالى 19 جثماناً، خلال عدوانه عام 2014، وخمسة آخرين احتجزهم في ما يعرف بعملية النفق، فضلاً عن اختطاف جثامين قتلى سقطوا أثناء مشاركتهم في مسيرة العودة على الحدود الأمنية بين المنطقتين. لكنه لم يعترف بهم، ويرفض الإدلاء بأيّ معلومات عنهم وفقاً للحملة الوطنية لاسترداد الجثامين. تؤكّد سلوى ذلك بأنّ إسرائيل ترفض إعطاء أي معلومات عن مقابر الأرقام، لكنها مسؤولة عن معرفة أماكنهم، ومطالبة بإعادتهم إلى عائلاتهم. في المقابل يدعي الجيش أنّ هناك إشكالية في موضوع تسليم الجثامين، لعدم توثيقه الدقيق لمَن يوجد في هذا القبر، وعدم معرفته بهوية تلك الجثث. وحول الفئة المحتجزة، تقول منسقة الحملة الوطنية إنّه لا يوجد نظام معين تعتمده إسرائيل في احتجاز الجثامين، بينما يدعي الجيش في جلسات المحاكم أنه يحتجز مَن يُقتل في عملياته ومن ينتمي إلى حركة حماس. وفي سياق متصل، تنفي سلوى ادعاءات الجيش، مشيرة إلى أن “هناك جثامين أطفال، من غير المعقول أنّهم مسيسون”. استغلال وتنوي إسرائيل استخدام ملف الجثامين المحتجزة في صفقة تبادل مرتقبة مع حماس أو في معرفة معلومات عن جنودها في غزّة. وتوضح سلوى أن الحملة الوطنية لا تملك أي معلومات عن صفقة قادمة، وإذا كان سيتمّ إدراج موضوع جثامين الشهداء ضمن أيّ مفاوضات فيها، لكن رأي العائلات رافض تحويل الملف إلى تفاوضي. وبعد قرار الكابينت، احتجزت إسرائيل ما يزيد على 230 قتيلاً، فيما يكون العدد الإجمالي 253 في مقابر الأرقام، وتشير سلوى إلى أن اللجنة الوطنية وثّقت ذلك، وتوجّهت عام 2016 إلى المحكمة العليا الإسرائيلية بملف 116 من قتلى مقابر الأرقام، وكانت اللجنة واثقة أنهم موجودون في مقابر الأرقام، لكن إسرائيل نفت علمها مكانهم. وكرد فعل تتساءل “هل يمكن لمؤسسة عسكرية كالجيش الإسرائيلي أن تدفن بشكل عشوائي؟”. الأمر الذي دفع الحملة الوطنية إلى استرداد الجثامين عبر المطالبة بإجراء فحوص الحمض النووي للقتلى وذويهم، وتأسيس بنك للحمض النووي، ووافقت إسرائيل على ذلك من دون التنفيذ. على الصعيد القانوني الإسرائيلي، لم تأخذ المحكمة قراراً سلبياً حول استرداد الجثامين، لكنها تماطل وتؤجل، بينما تحاول المؤسسة العسكرية والسياسية تشريع ذلك باعتمادها على القانون البريطاني بالمادة الثالثة التي نصت على دفن الجثامين في مناطق بعيدة عن سكنهم وعائلاتهم. لكن ذلك مخالف
