اندبندنت عربية/ عاطف قدادرة صحافي @atefked بإعلان رئاسة الجمهورية في الجزائر بدء مراجعة قانون الانتخابات، استباقاً لحل البرلمان وإقرار انتخابات تشريعية مبكرة، يراقب سياسيون احتمالات الإبقاء على نظام المحاصصة للمرأة في القوائم الانتخابية أو إلغائه في سياق انقسام في الشارع حول نتائجه. وضمن ما سماه الرئيس الجزائري السابق عبد العزيز بوتفليقة “حزمة الإصلاحات السياسية” التي تقررت في فترة متزامنة مع ثورات الربيع العربي، أقر نظام محاصصة يقضي بفرض نساء في حدود 30 في المئة ضمن قوائم الأحزاب المتنافسة على مقاعد البرلمان. وعلى الرغم من الدفاع المستميت من قبل تنظيمات نسائية عن هذا النظام، فإنه لاقى انتقادات كبيرة من مؤسسات حزبية اعتبرته انتقاصاً من كفاءة المرأة. بينما رأت أحزاب محافظة أن القانون يناقض المنطق السائد في بعض التكتلات المجتمعية التي لا تتقبل ممارسة المرأة للسياسة، وبالتالي كان على الأحزاب البحث عن مرشحات خارج إطار المناضلين، بما يسمح بوصول نساء لا يستحققن هذه المكانة. برلمان هجين في خطابه إلى اللجنة المكلفة بمراجعة قانون الانتخابات، برئاسة البروفيسور أحمد لعرابة، لم يكشف الرئيس الجزائري عبد المجيد تبون عن نواياه بشأن حصة المرأة في المجالس المنتخبة، مكتفياً بالدعوة “إلى البحث عن مقاييس جديدة يجب أن تراعي في حدود الممكن الجمع بين الكفاءة والتجربة في المرشحين، بخاصة في المدن الكبرى”. ونقل عن تبون قوله “كما لا ينبغي أن تحرم أي مواطنة أو مواطن يتمتع بحقوقه السياسية والمدنية من الترشح لأسباب سياسية، ضماناً لتوفير فرص متكافئة للجميع في الترشح، والرقي الاجتماعي والسياسي”. من جانبه، قال حسين خلدون، القيادي السابق في جبهة التحرير الوطني، والرئيس السابق للجنة الشؤون القانون بالبرلمان لـ”اندبندنت عربية”، إن “فرض قائمة تشكل النساء فيها 30 في المئة على الأقل في القانون الساري المفعول كان اعتداءً على مبدأ المساواة بين الجنسين المنصوص عليه في دستور البلاد”. ويذكر خلدون الظروف التي أدت إلى إقرار هذا النظام، قائلاً “كانت فكرة السلطة القائمة يومها تصدير صورة مغالطة عن واقع المرأة في البلاد، والهدف كان الترويج لديمقراطية واجهة. كلامي هذا لا يعني الوقوف ضد طموحات المرأة الجزائرية، بل لأن هذا النظام جاء مجحفاً بحقها ويتعامل معها كبشر منقوص الكفاءة”. ويروي خلدون كواليس مناقشة هذا النظام على مستوى البرلمان عام 2011، قائلاً “الحكومة يومها كانت تعتبر هذا النظام مرحلة انتقالية زائلة بمجرد كسر ما سمته (طابو) تعود الشارع على حضور المرأة في الحياة السياسية، إلا أن هذا القانون لا يزال ساري المفعول على الرغم من أنه ظالم لكل من المرأة والرجل على حد سواء”. ويتابع “تفكير الجزائريين عموماً قد تجاوز هذا النقاش بسنوات ضوئية، كما أن القانون غير دقيق، حيث إن حصة المرأة وفقه هي 30 في المئة، لكن عدد النساء بين ولايتين تشريعيتين متتاليتين في 2012 و2017 جاء متبايناً”. ويقصد القيادي السابق في حزب الغالبية البرلمانية اختلاف كيفية احتساب عدد مقاعد المرأة في البرلمان بين محافظة وأخرى، حيث لا تملك ثماني محافظات على الأقل من أصل 48 أي تمثيل نسائي، فيما لا يطبق هذا النظام تماماً في المجالس المحلية التي يقل عدد سكانها عن 20 ألف نسمة. ويعتقد نطاق واسع من المراقبين أن أحد أسباب عدم رضا الجزائريين عن تشكيلة البرلمان الحالي، مستوى عدد من البرلمانيات. يضاف إلى ذلك تحول هذا المجلس إلى “غرفة تسجيل” لا تبادر بالتشريع. ففي بعض المحافظات لجأت أحزاب إلى البحث عن وجوه نسائية من دون تدقيق في مستواها التعليمي لمجرد الالتزام بنص القانون بما يضمن الحصول على موافقة وزارة الداخلية”. إلغاء مقابل جو شفاف يقترح خلدون “مراجعة هذا النص لأنه ينتقص من حضور المرأة ولا يخدمها، وإلغاء نظام القوائم النسبية المغلقة وتعويضه بالقوائم الاسمية، وإعادة النظر في تقسيم الدوائر الانتخابية، لأنه أحد أسباب ظاهرة العزوف عن التصويت”. من جانبه وصف الهادي حابل، عضو فرع جهوي للرابطة الجزائرية للدفاع عن حقوق الإنسان، لـ”اندبندنت عربية” تبعات فرض قانون محاصصة للمرأة بـ”أحد معالم الفساد السياسي الذي ميز الفترة السابقة عموماً”. ويشرح “لقد أغرقت الجماعة الحاكمة سابقاً المنظومة الانتخابية بمفاهيم جديدة تحولت مع مرور الوقت إلى ما يشبه المسلمات، لا أفهم دوافع دفاع البعض عن هذا النظام على الرغم مما يحمله من ظلم لحظوظ المرأة”. أما عن نوايا السلطة حالياً، فلا يرى حابل فرصة كبيرة لإلغاء هذا النظام الانتخابي إلا في حال تقديم مبررات جديدة. إذ “تدرك السلطة جيداً مكانة المرأة في منظومة التصويت عموماً، لذلك قد تخضع نية التراجع عن هذا النظام لحسابات غير منطقية”. ومكمن هذه الخشية “هو احتمالات تأويل إلغاء هذا النظام على أنه تراجع عن مكاسب المرأة، أو توقع انقلاب في موقف بعض المنظمات الجماهيرية النسائية كاتحاد النساء الجزائريات، لكن الجدية في عرض قانون انتخابي غير ظالم تتطلب مواجهة النقائص التي أدت دائماً إلى تشكيل مؤسسات منتخبة منقوصة الشرعية”. عدم دقة القانون بلغة الأرقام، بلغ العدد الإجمالي للنساء المرشحات في آخر انتخابات برلمانية، التي جرت في مايو (أيار) 2017، قرابة أربعة آلاف امرأة، أي 31.33 في المئة من إجمالي عدد المرشحين. وفازت 120 امرأة بمقاعد في المجلس الشعبي الوطني (الغرفة الأولى للبرلمان) من بين 462 مقعداً، لكن اللافت للانتباه أن عدد النساء الفائزات في انتخابات البرلمان عام 2012 بلغ 146، مما يعني فعلاً عدم الدقة في ضبط القانون لتحصيل نتائج ثابتة. واعتبر تقرير للاتحاد البرلماني الدولي، أن إدخال نظام الحصص في الجزائر، عام 2012، أدى إلى زيادة نسبة البرلمانيات إلى نحو 32 في المئة، بزيادة 6.2 في المئة، ثم انخفضت هذه النسبة، عام 2017، إلى 25.8 في المئة. ومع ذلك فقد تقدمت الجزائر في الترتيب الدولي من حيث التمثيل النسائي في البرلمان، حيث احتلت المرتبة 29 وفق أرقام عام 2017،
