الدولة في مجال الأمن؟ اندبندنت عربية \ منى عبد الفتاح يبدو أن الضلع الثالث من شعار الثورة السودانية “حرية سلام وعدالة” هو أبعد الأمنيات عن التحقق في ظل دستور معطل، وعدم الوصول إلى المتسببين في مقتل المتظاهرين. سؤال عبر عنه وطرحه مباشرة رئيس مجلس السيادة الفريق عبدالفتاح البرهان خلال لقاء تلفزيوني أخير، وهو وإن كان يتردد في أذهان كثيرين إلا أن تساوى الحيرة في الإجابة عنه بين المسؤول والجمهور يقود إلى أسئلة أخرى، عن مدى تقاعس السلطة عن ملاحقة الجناة الحقيقيين إن كان ثمة جناة آخرون، وعن قصور الدولة في مجال الأمن وعمن أوصل البلاد إلى هذه الحال. يحدث ذلك بعد الثورة التي أتت بحراك اقتصادي – سياسي نتيجة للأزمة التي تسبب بها النظام السابق ببقائه في الحكم ثلاثة عقود، وحركها رفع الدعم الحكومي عن المحروقات، ولكن يدخل الشارع الثائر في حال حراك حقوقي يتهم فيه بعضه الدولة بتقاعسها عن دورها في التحقيق عن المسؤول من مقتل المتظاهرين، بينما يرى آخرون أن هناك طرفاً ثالثاً هو المسؤول عن ذلك. وتعبر الأجواء السياسية المشحونة عن التوق إلى إيجاد متهم يتحمل المسؤولية كاملة، وهو أريح لكثيرين من متهم وهمي أو هلامي لا يزال البحث عنه جارياً. أزمة متجذرة قال المتحدث الرسمي باسم “حركة العدل والمساواة” محمد زكريا إن “الثورة اتسمت بسلميتها وشعاراتها المعروفة (حرية سلام وعدالة)، الحرية التي تتضمن حرية التعبير والتظاهر، والسلام المتمثل في إشاعة الأمن والاستقرار والحفاظ على الأرواح، والعدالة المتمثلة في الإنصاف والقصاص لكل المظلومين”. وأوضح أن “حكومة الفترة الانتقالية كانت مهتمة بإنجاز العدالة لضحايا التظاهرات، ليس في الخرطوم وحدها وإنما في المدن كلها، في دارفور وعطبرة ومنطقتي جبال النوبة والنيل الأزرق وغيرها، وتشكلت لجنة نبيل أديب للبحث في موضوع فض الاعتصام الذي حدث عام 2019، وتلك اللجنة لم تر نتائجها النور بعد”. وأضاف، “مثل هذه القضايا يزداد تشعبها في مناخ جماهيري متأهب، ولكن ينبغي النظر إلى حقيقة أن عملية الاغتيالات وسقوط الشهداء هي عرض لأزمة متجذرة، وهي الأزمة السياسية السودانية، إذ إنه ما لم يتم التوافق بين المكونات السياسية سيكون الانقسام هو النتيجة الحتمية للتحشيد القائم الآن، وسيكون له أثر في تعقيد عملية الوصول إلى المتسببين في سقوط الضحايا”. وأشار زكريا إلى أن هناك اتهامات تشير إلى طرف ثالث مسؤول عن مقتل المتظاهرين. أما عن مسؤولية أجهزة الدولة، فأشار الفريق البرهان إلى حالات أطلق فيها نظاميون الرصاص على المتظاهرين، وتخضع هذه الحالات للبحث والتحري. وأكد أن “المسألة في مجملها تحتاج إلى تحكيم سياسي – قانوني حتى تظهر إجابات مقنعة”. وأعرب زكريا عن أنهم كقوى سياسية وحركات كفاح مسلح، وجزء من الجهاز التنفيذي والسيادي الحاكم، فشلوا في الإجابة عن سؤال “من يقتل المتظاهرين، لأن الإجابة ليست مقتصرة على النظام الحاكم وإنما الأجهزة السياسية جميعها مسؤولة عن الانتهاك والتقصير”. أخطاء الممارسة السياسية أضاف المتحدث باسم حركة العدل والمساواة أن “الاستفهامات عمن يقتل المتظاهرين ليست مؤسسة على قرائن قانونية كأمر مطلق، فالمسؤولية الأخلاقية للأجهزة النظامية هي بحكم الوظيفة وحكم التفويض، ولكن يجب ألا ننسى أن قيادة هذه الأجهزة قد تعرضت للقتل غيلة وغدراً أيضاً مثل حادثة العميد علي بريمة حماد أثناء تأديته واجبه، والتعدي على ضباط آخرين في الجيش والشرطة والقوات النظامية”. وقال، “شاب الثورة في حالات كثيرة جنوح بعض الفئات إلى العنف والتخريب واستعداء المكون العسكري في القوات المسلحة والدعم السريع، وهذا ما لم يحدث في تاريخ الدولة السودانية والثورات السابقة، إذ إنه بانحياز الجيش إلى خيار الشعب باعتباره جزءاً أساساً ومكملاً للثورات، يحصل الجيش على مزيد من الاحترام الذي يستحقه، وهو ما لم يحدث الآن”. وأوضح، “نحن كقوى سياسية نؤمن على الحكم المدني الذي لن يتحقق إلا بوفاق سياسي يرصف الطريق إلى حكومة مدنية، ونرى أن تكون الأجهزة الأمنية على سدة الحكم، في ظل الانشقاق القائم، حتى يتفق الجميع ويتحقق شرط الانتقال ومن ثم الذهاب إلى الانتخابات لقيادة البلاد، فحتى الآن لم يتم تأسيس مفوضية ولا قانون للانتخابات، وتشعبت القضايا التي تعرقل الوصول إلى نقاط مشتركة وأرضية واحدة وبرنامج متفق عليه، ويمكن أن تكون ساحة للتنافس الشريف على الحكم”. ورأى زكريا “تعسف الخطاب السياسي المستخدم بواسطة النخب السياسية والحرص على الأجندات الحزبية الضيقة، واستعجال الانتقال بطريقة تخدم قوى بعينها أحدث حال الشقاق هذه واستمرار حالات العنف المتمثلة في قتل المتظاهرين”. واعتبر أن “وضع الحكم العسكري كمضاد للحكم المدني في أذهان كثيرين أضر بالفترة الانتقالية، ونتج منه الشتات الذي ضرب المكون المدني بتقلصه من أكثر من 100 مكون مدني إلى أربعة فقط، وهذه الأخطاء في الممارسة السياسية هي التي جعلت الاتهامات من كل طرف ضد الآخر، ونحن في العدل والمساواة مع تفكيك النظام السابق ولكن يجب أن يكون وفقاً لأطر قانونية، وتفكيك للمؤسسات وليس الأفكار والتشفي من الأشخاص، ونشدد على الشراكة المدنية – العسكرية لأن وجود العسكريين مهم لاستكمال الفترة الانتقالية”. مسؤولية شاملة من جانبه، قال عضو اللجنة القانونية لقوى إعلان الحرية والتغيير عمر سيد أحمد إن “القوانين والمواثيق الدولية تحفظ حق التعبير والتجمع والتظاهر السلمي، والسؤال الذي يجب طرحه هو من المسؤول عن حماية المتظاهرين السلميين وحماية التعبير عن الرأي؟ والإجابة عنه تكون في أن المسؤولية تقع على عاتق الجهاز المنوط به إدارة الدولة، والسؤال الموجه إلى الفريق البرهان عمن قتل المتظاهرين، ثم إجابته بأنه لا يعلم، ففي النهاية هذه المسألة قانونياً وسياسياً تقع على عاتق رأس الدولة قبل انقلاب 25 أكتوبر (تشرين الأول)، وبحكم الأمر الواقع باعتباره يدير كامل الدولة الآن وتحت يده الأجهزة الأمنية، وهذه مسؤوليته في حماية هؤلاء المتظاهرين، وأي تهرب من المسؤولية غير مجد وهو عبارة عن مراوغة ليس إلا”. وأضاف سيد أحمد، “تمتد المساءلة لتشمل ضحايا اعتصام ميدان القيادة العامة للقوات المسلحة، إذ تقع مسؤوليتها أيضاً على الأجهزة الأمنية، فوفقاً للتراتبية العسكرية والتسلسل الهرمي للقيادة ومن تحت إمرة القائد العام للقوات المسلحة من ضباط ومساعدين وغيرهم، نجد أن المسؤولية تقع بكامل ثقلها على عاتق قيادات الأجهزة العسكرية، وذلك باعتبار أن القائد العام للجيش مسؤول مسؤولية أساسية ومباشرة عن جنوده وعن أي انتهاكات تبدر منهم أياً يكن منفذها، هذا في حال أثبت التحقيق ضلوع الأجهزة العسكرية في هذه الأحداث”. وأوضح، “ينص القانون الجنائي الإنساني على الجرائم التي تحدث في مناطق النزاعات المسلحة مثل الجرائم ضد الإنسانية والإبادة الجماعية والاغتصاب والقتل خارج نطاق القانون، وهذه عادة تقوم بها قوات وميليشيات مسلحة وتتحمل قياداتها مسؤوليتها، ويكون البحث والتحري والمقاضاة أموراً معقدة وفق البيئة التي تحدث فيها مثل هذه الجرائم، أما في حال مقتل المتظاهرين فالنصوص الجنائية تكون عامة لمنع الجريمة، وليس هناك نصوص خاصة إلا لجريمة القتل بطبيعتها العامة”. انطباع سلبي وفي التعليق على قضية مقتل المتظاهرين، قال الأمين العام لمنظمة الشباب الثوري للديمقراطية والتنمية حسام هيثم إن “من يتسبب في مقتل المتظاهرين جهات معلومة مكونة من الأجهزة الأمنية ومكلفة من قبل مجلس السيادة الانتقالي بتفريق المتظاهرين، مما ينتج منه استخدام العنف المفرط غير المسموح به دولياً، ومنه استخدام الرصاص الحي الذي يؤدي مباشرة إلى وقوع ضحايا من المتظاهرين العزل، وسقوط ضحايا بطريقة غير محتسبة”. وأضاف، “هناك جهات غير معلومة تتهمها الأجهزة الأمنية كطرف ثالث وتعجز عن إظهارها للعامة، كما تعجز لجانها المكونة للتحقيق عن كشف أي معلومة تقود إلى الحقيقة، وهذا يدل على تورط الأجهزة الأمنية واتهامها لطرف ثالث يصبح باطلاً، خصوصاً مع وجود توثيق واضح لعمليات القتل والعنف المفرط من الأجهزة الأمنية التي تقمع المتظاهرين، وهنا يكون المسؤول الأساس هو رئيس الحكومة وحكومته”. ووصف هيثم الانطباع العام بأنه سلبي تجاه المجلس السيادي بعد انقلاب الـ 25 من أكتوبر، وبينما أعلن رئيس مجلس السيادة بأنه لتصحيح المسار، لكن ثبت العكس بأن عقد المشهد السياسي والاقتصادي، بل نتج منه سقوط ما يزيد على 80 ضحية ومئات من الجرحى والمصابين”. وذكر أن “حديث البرهان لا يرمي إلى تأسيس حوار جاد كما ظل يطرح دائماً، إذ يجب على المجلس العسكري الاعتراف بالأخطاء أولاً وتقديم التنازلات وتقديم الجناة الذين أسهموا في سقوط الضحايا منذ أحداث ميدان الاعتصام إلى العدالة، فهذا ما يؤسس لحوار جاد”. مهدد أمني وتابع هيثم، “نظراً إلى أن قضية هؤلاء الضحايا هي قضية جنائية وثبت وجود مجني عليهم، فإنه لا بد من وجود جان أو جناة، وهؤلاء لن يتم التوصل إليهم إلا برعاية دولية تصل إلى مرحلة التقاضي، إنما المؤسف في هذا الأمر هو أنه يصعب تحقق ذلك في ظل حكومة طوارئ وانقلاب على الانتقال المدني الديمقراطي، إذ غالباً ما تطرح قضايا الضحايا وفض الاعتصام على أساس أنها قضايا سياسية، وهناك بعض القوى تتكسب منها، لذلك يضيع الجانب القانوني وسط الصراعات السياسية”. وختم هيثم كلامه بالقول إن “معظم القادة العسكريين وبعض المدنيين يعتقدون أن عرض نتائج التحقيق في أحداث فض الاعتصام ومقتل المتظاهرين سيكون مهدداً أمنياً ومهدداً لأوضاعهم، وهذا ما يجعل المطالبة بحكم مدني تزداد يوماً بعد يوم حتى يصاغ دستور وقوانين ومؤسسات عدلية تحاسب من يتسبب في أية انتهاكات بكل شفافية، ونحن كشباب ثوري خرجنا من أجل تحقيق أهداف الثورة والعدالة وظللنا نطالب بالقصاص الذي يشكل مطلباً أساساً الآن، ويسهم في تشكيل المشهد السياسي الحالي”. حجر عثرة ويرى الناشط السياسي الباقر درويش أن “السلطة العدالة، لأنها بحسب إشارات عدة إما متورطة في قتل المتظاهرين واعتقال الناشطين، وليس بعيد من ذلك ما يحدث من عنف مفرط وقتل للثوار وإخفاء قسري للناشطين من الساحة السياسية، أو أنها متواطئة مع الجناة بشكل أو بآخر، وأياً يكن الأمر فإنه ينم عن فشل ذريع لأن تحقيق العدالة يحتاج إلى إرادة وشجاعة وصدق، وذلك غير متوافر لدى الانقلابيين على الرغم من أن ملف العدالة الانتقالية متعلق بالجرائم التي ارتكبت في عهد
