لم تكن هيّنة أكد الباحث التونسي د. رؤوف دمق أنّ النّقيصة الأولى التي منعت الفكر العربيّ الحديث من ضبط مناهجه هي أوّلاً وأساساً عدم الاتّفاق بعد حول ماهيّة التّراث وحقيقته، فقد آمن الجميع بضرورة فهم الذّات في هذا الواقع الحضاري الذي صار يفرض علينا الاندماج مع الآخر، وهو واقع تسوده قيم العولمة الحاكمة بالموت على من يرفضها. ولكنّ الجميع لم يهتدِ إلى معنى الذّات المتلبّس بضبابيّة التّاريخ ماضياً وتداخل الأنظمة الثّقافيّة حاضراً. ورأى أن كتابه “أثر الأصول التكميلية في فقه السنة” يتنزّل في تاريخ التّشريع الإسلامي ومناهجه طول عشرة قرون، حيث شمل محورين من محاور التّراث الإسلاميّ هما النّظريّة الأصوليّة والممارسة الفقهيّة. وكان المدخل إليهما “المتمّمات” أو الأصول “التّكميليّة” متمثّلة في الاستحسان والمصلحة المرسلة والعرف. وقد اقتضى البتّ في الشّكل الحقيقيّ لـ “أثر الأصول التكميليّة في فقه السنّة” توسيع مجال الدرس ليشمل ثلاثة مذاهب تشترك في انتمائها الشّكليّ إلى التيّار السنيّ، وهي المالكيّة والحنفيّة والشّافعيّة، وتوسيع المدى الزّمنيّ بالانطلاق من المراحل التّأسيسيّة وصولاً إلى المتأخّرين من العلماء المنتمين إلى مدارس مختلفة في الظّاهر. وأشار الباحث التونسي في كتابه الصادر عن مؤسسة مؤمنون بلا حدود إلى أن تأخّر حسم الفكر العربيّ المعاصر في ضبط طرائق التّحديث، على الرغم من مرور أكثر من قرنين على ميلاد ما سُمّي عصر النّهضة، ما جعل التّسمية ذاتها تفقد وجاهتها، وتتراجع تراجعاً دالاً على مقدار التّخبّط في تحديد جهة السّير ومراجع النّظر ومناهج التّفكير. إنّ لوطأة الحاضر المتأزّم أثراً لا يُنكر في تضييق سبل استشراف المستقبل وانحباس آفاق انتظار الغد المأمول، ولكنّ ما زاد العمليّة عسراً التّردّد في أشكال الارتباط بالماضي أو فكّ الارتباط عنه. ومثّل الإسلام في هذا الماضي جزءاً مهمّاً جدّاً في التّركيبة السّياسيّة والهرميّة الاجتماعيّة والعائليّة وأنظمة التّبادل الاقتصاديّ وطبيعة العلاقة مع “الآخر الدّينيّ” في حالتي الحرب والسّلم، وشكّل مخزوناً معنويّاً هائلاً طبع التّركيبة النّفسيّة للفرد وسط الجماعة. ولفت إلى أن مقاربة التّشريع الإسلامي في تشعّباته التّفصيليّة وأسسه النّظريّة لم تكن هيّنة؛ وقال “ذلك أنّ الموسوعات الفقهيّة التّأسيسيّة لم تحفل بتحديد مراجعها، والتّمييز بين القاعديّ والاستثنائيّ وبين المركزيّ والهامشيّ، ما سمح لمنظّري القرن الخامس للهجرة بالانزياح بعلم أصول الفقه من التّأصيل إلى الاستئصال، ومن التّقنين والتّنظير إلى الحذف والتّشويه والإضافة. ويتعلّق الأمر بأصول الرّأي والعمران تعلّقه بالأدلّة النّقليّة الأربعة؛ إذ لم يتيسّر تحويل الممكن إلى واجب والاحتمال إلى يقين والمشروع إلى ممنوع إلا بممارسة فعل تأويليّ بعيد مبالغ في التّعسّف لإنطاق التّجارب الأولى بما لا تحتمله وما يتعارض مع منطلقاتها وإلغاء أبعاد أصيلة في تراث القرون الأربعة الأولى لقطع مسار تطوّرها وسيرورتها الطّبيعيّة نحو القبول التّدريجيّ بمنطق تحوّل القانون وصفة البشريّة فيه. لقد كان علم أصول الفقه علم المُثل بامتياز، رام القطع مع التّاريخ والتّسامي إلى المقدّس فانتهى إلى قتل التّشريع الإسلاميّ بتقنينه في أطر نظريّة تضيق عن استيعاب شؤون النّاس، ولا تتطابق مع الماضي، على الرغم من عودتها الظّاهرة إليه باستمرار، ولا توجّه الحادث والمستقبل إلا بفرض التّسليم بضرورة الحفاظ على الطّابع الإلهيّ للحكم، على الرغم من أنّ الخطاب القرآنيّ وممارسة الرّسول كانا يسيران في اتّجاه توكيل الشّأن القانونيّ للمؤمن وإقناعه بمرونة الحكم وقابليّته للمراجعة المستمرّة بشرط حسن النّوايا وضمان ملامسة الغايات الجوهريّة للدّين الجديد، وعدم المسّ بكلّياته وهويّته. ولئن شرعت الأعمال الفقهيّة الباكرة في السّير على النّهج النّبويّ الإلهيّ فقد قطع علم الأصول وما جاء بعده من كتابات فقهيّة مع هذا النّهج، فلم يكن وفاء المنهج النّقليّ الرّسميّ المعتمَد لتعاليم السّماء إلا حجاباً يُخفي النّقيض، يعتمد تحريفاً بيّناً للتّراث وتهافتاً داخليّاً واضحاً لخطابه “الاستدلاليّ” مأتاه التّناقض بين المقدّمات والنّتائج”. وأوضح الباحث التونسي أن الفقه الإسلاميّ مر بطورين رئيسين لا ثالث لهما إلى اليوم: طور الفاعليّة وطور المفعوليّة، اقتصر الأوّل على قرنين، وامتدّ الثّاني قروناً عديدة، أنتج الأوّل فقهاً عمليّاً قابلاً للتّطبيق يراعي احتياجات المؤمن وظروف حياته وخصوصيّات بيئته المناخيّة والطّبيعيّة والحضاريّة والتّركيبة الاجتماعيّة ونظم الاقتصاد والتّبادل التّجاريّ والهرميّة السّياسيّة وحتّى الاستعدادات النّفسيّة والعقليّة للجماعة، ولا يعني ما سبق أنّه كان فقهاً مثاليّاً يتطابق تماماً مع غايات الدّين الجديد، ونجح في تكييف الأذهان مع قيم الإسلام جميعها، إنّه لم يُكتب له من كلّ ذلك غير الشّروع، وهو كلّ الممكن طول قرنين فقط في حضارة لم تعتد أن تنظّم شؤونَ معاشها في دساتير مكتوبة وطقوسَ تعبّدها في أقانيم موحّدة أو حتّى متنوّعة. إنّ التّحوّل من عفويّة الاعتماد على الأعراف إلى تقنين القانون في شكل فتاوى مختلفة بحسب البيئات وزاوية نظر الفقيه يحتاج إلى مدى زمنيّ طويل، ولئن نجح علماء العراق والمدينة في لفت نظر المؤمنين إلى أحكامهم ومواقفهم فلم يلزموهم بها، ولم يدّعوا احتكار الحقيقة وهو ما وجد تعبيره في امتناع مالك عن إلزام الأمصار بموطّئه، لكنّهم لم يصلوا إلى مرحلة القناعة بتفوّق التّاريخيّ على المقدّس في التّشريع، وإنّما ظلّت رؤيتهم متردّدة بين المرجعين في جدل حيّ مخصب أفرز مواقف جريئة لم تتوانَ عن مراجعة بعض الأحكام القرآنيّة متى أيقنت عدم تواصل الحاجة إليها، أمّا تعاملها مع السنّة في صيغتها الأصوليّة المتأخّرة؛ أي التي تقرنها بشخص النّبيّ فلم يكن تعاملاً عموديّاً وثوقيّاً تسليميّاً ولا رفضاً من حيث المبدأ، وإنّما كان العالِم إلى هذا الدّور قطباً موازياً لشخص النبيّ لا يستنكف من الاهتداء بمنهجه ولا يقبل الاكتفاء بترديد آرائه والانحسار في دائرة ما يقول أو يفعل أو يقرّر أو يترك. فعل المراجعة يحتاج اليوم إلى التّسلّح بعدّة فكريّة نقديّة ضروريّة للتّمييز بين التّاريخيّ والأسطوريّ والحقيقيّ والوهميّ احتياجه إلى استعداد نفسيّ لتحمّل تبعات البحث العلميّ المحايد وكلّ النّتائج المترتّبة عليه وأضاف “لكنّ المتأخّرين وجدوا أنفسهم في إطار ثقافيّ مغاير أساسه تحويل السنّة من دلالتها الشّعبيّة الواقعيّة إلى دلالتها النّبويّة الماضويّة المثاليّة والارتقاء بها حلاً شكليّاً مانعاً من التّصريح باعتماد الأصول العقليّة والعوائد والمصالح، وإن كان في الأغلب مجرّد غطاء لها، فصار الفقيه يوجّه مجهوده العقليّ في صناعة النّصوص أو البحث عن أشكال من الارتباط بها واهمية دورها الإخفاء لا الإظهار، وتقديم الجواب الجديد متماهياً مع أصول الثّقافة السّائدة وإعادة صياغة الجواب القديم لاحتواء شذوذه عن تلك الأصول. من هنا نقرّر أنّ علاقة علم الأصول بالفقه تمثّلت في احتواء السّابق بتحريفه وتزييفه واحتواء اللاحق بضبط مراجع النّظر وتضييق هامش حريّة العالِم وتخويفه من تخطّي الحدود المشروعة، فانتهى إلى تشويهه ومن ثمّ قتله. وقال الباحث التونسي إن المتتبّع لحياة المذاهب الفقهيّة يلحظ من خلال نماذج الشّافعيّة والحنفيّة والمالكيّة، أنّ المذاهب الإسلاميّة إلغاء للتّمذهب؛ إذ إنّ حركة تطوّرها كانت تسير في اتّجاه تذويب الاختلافات والتّقارب التدريجيّ المشارف حدّ التّماهي، وهو تطوّر عكسيّ: فالمفروض أنّ الاختلافات الأوّليّة الحادثة في صدر الدّولة الإسلاميّة تتوالد بمفعول دخول أقوام جديدة في الإسلام، ووصول الدّين الجديد إلى أصقاع ذات تقاليد وثقافات مغايرة للمركز، لكن تمّ حَجْبُ البيئة والواقع بِحُجُبٍ نصيّة وهميّة النّسب شكليّة الارتباط بالقضيّة محلّ النّظر، وصار دور العالِم محاولة خلق تجانس بين السّائــد الاجتماعيّ والموروث الثّقافيّ بصناعة نصوص تنطوي أحياناً على تعارض داخليّ، كما في مسألة النّكاح بغير وليّ، نصوص موضوعة قياس قواعد فقهيّة بعديّة الظّهور، تحمل أحياناً تفاصيل واصطلاحات لم تكن مألوفة في مجتمع الدّعوة بما يقيم الدّليل على تأخّر نشأتها. ومن هذا المنطلق لم يعد إطلاق القول بمالكيّة أبي الوليد الباجي منظّراً، وابن الحاجب فقيهاً، وشافعيّة الرّازي والسّيوطي، وحنفيّة السّرخسي، إطلاقاً مشروعاً، فالجميع ينتمي إلى خطّ واحد ويصدر عن المنطلقات ذاتها، ولا معنى للفصل والتّمييز، لقد ضاعت الأصالة المذهبيّة في إطار بحث المتأخّرين عن الانتماء إلى الثّقافة النّقليّة السّائدة، وقدّم العلماء تنازلات كبيرة في شأن مبادئ الإمام من جهة ومقتضيات وظيفة العالِم من جهة ثانية. وأكد الباحث التونسي أن بحثه يفيد في الاقتناع بضرورة تحاشي ترديد الشّعارات والتّصوّرات الخاصّة بسبل تجديد الفكر الدّينيّ دون التّثبّت في مدى انسجامها مع الواقع في الماضي والممكن في الحاضر. فلا سبيل إلى تبنّي خيار إعادة فتح باب الاجتهاد “الذي يُعتقد أنّه أُوصد في عصور الانحطاط بعد الاكتفاء منذ القرن السّادس بالتّكرار والاجترار والجدل المذهبيّ” وتجاهل كون المنظومة الأصوليّة وُلدت منغلقة، وما بقاء العلماء في القرنين الثّالث والرّابع مقصّرين في الكتابة إلا بفعل الارتباك الذي أحدثه الشّافعي بفرضه منهجيّة تشريعيّة جديدة على كلّ الأمصار بعد تنوّع المقاربات والحلول. وانتظر العلماء الإسهاب التّنظيريّ التّقعيديّ المشترك في أسسه بين رموز المذاهب خلال القرن الخامس للحسم في حتميّة توحيد التّشريع من خلال إقصاء الأصول العقليّة والاجتماعيّة والانغلاق في دائرة النصّ اللّغوي البشري لا الإلهيّ: نقول ذلك لأنّ عدداً من النّصوص كان مضافاً بعديّاً ومصنوعاً وفق رؤى تشريعيّة حادثة، وخضع عدد منها إلى عمليّات تأويليّة متعسّفة أظهرها إضافة مقاطع نصيّة تستبدل الدّلالة الأولى العامّة بأخرى مقصودة، فلم يبقَ للنصّ الدّينيّ إلا الصّورة وملأ العالِم الإطار بما يتماشى والرّغبة الرّسميّة في تحجير الفقه الإسلاميّ، وإلغاء وظيفة المفكّر؛ أي العالِم إلغاء تامّاً. وشدد على إنّ قبول المنظومة الأصوليّة يستتبع الوقوع في شراكها الذي لم يستطع علماء الإسلام الفكاك منه، فأحاط بهم، وشلّ حركتهم وقيّد أذهانهم. ولا يعني ذلك أنّ التّراث الإسلاميّ صار مكبّلاً معرقلاً للتطوّر، وإنّما ضرورة التّعامل الحذر مع الإنتاج البشريّ المشكّل لهذا التّراث؛ أي الوعي بأنّ ما تمّ تقديمه إلينا على أنّه الواجب الدّينيّ الصّادر عن الله إنّما هو مجرّد إمكان صنعه الإنسان، وساعدت جملة من الظّروف والأطراف على سيادته وتحوّله إلى سنّة ثقافيّة متّبعة. فتكون الخطوة الأولى في ضبط سبل التّعامل السّليم مع التّراث البتّ في ماهيّة هذا التّراث. ومثلما لا يُنتظر إفلاح أمّة في أن تبني مجدها على فراغ لا يُرجى فلاحها في انطلاقها من خواء عائد إلى عدم تماسك حلقات تاريخها تماسكاً طبيعيّاً قويّاً وقيامه على مراجعات مستمرّة في الماضي، أنتجت حينها حضارات استمدّت كينونتها من فعل المراجعة ذاته، وحين كفّ الفعل خفت بريقها بين حضارات باقي الأمم. ويحتاج فعل المراجعة اليوم إلى التّسلّح بعدّة فكريّة نقديّة ضروريّة للتّمييز بين التّاريخيّ والأسطوريّ والحقيقيّ والوهميّ احتياجه إلى استعداد نفسيّ لتحمّل تبعات البحث العلميّ المحايد وكلّ النّتائج المترتّبة عليه. وانتهى الباحث التونسي إلى إنّ الخطاب الدّينيّ مطالَب اليوم بأن يكون، أوّلاً وأساساً، خطاباً علميّاً متوجّهاً إلى عقول واعية باحثاً عن الاقتناع الذّاتيّ وإقناع المخاطب وتحاشي ترديد الشّعارات الخاوية من المعنى والأطروحات القديمة التي أسهمنا من خلال البحث في كشف زيف تماسكها الدّاخليّ واستحالة استنساخها من جديد، وإذا كان الكشف الأوّل خاصّاً بأغلبها فالثّاني يلفّ جميعها. ولكنّها تبقى مع ذلك منبعاً مرشداً إلى الأصلح كما كان القرآن وتجربة محمّد (صلى الله عليه وسلم) معيناً للاسترفاد المنهجيّ والبحث الغائيّ عمّا ينفع الإنسان. ولا يجب أن يُفهم ممّا سبق الانسلاخ التّامّ عن كلّ الضّوابط الدّينيّة بدعوى أنّها غير ملزمة، وإنّما اتّفاق كلّ جيل على ضوابطه القانونيّة وممارسته
